In California is it the landlords responsibility to showel snow off the renters roof?
We own a rental and the roof needs the snow shoveled off. This year we have more snow than usual and more coming. Is it the renters responsibility or the landlords to maintain the shoveling? We live in Northern California.

Why do you need to shovel the roof? Snow acts as an insulation, therefore keeping your heating bills down.
I live in Canada and we have snow all winter and I have never seen anyone shovel their roof.

If the landlord does the work and makes a less than perfect job and as a result somebody is injured the landlord could be sued for damages. Under California this would be limitless..

If the landlord does nothing He/She is guilty of nothing. The snow is an Act of God. Try suing God.

If you want the snow removed you can do it yourself, but at your own risk.

Typically the only time someone gets up on the roof to clear the snow is when they are concerned about damage to the roof and structure. The renter does not own the home, so why would they care.

So I think the responsibility would be on the landlord. If I were a landlord, I would not want the liability of risking my tenants falling off and hurting themselves. Therefore, I would either do it myself, or hire a professional to do it.

I don't think they would want a tenant up on the roof where any accidents can happen. Mention that to them when you call.

It is the Landlord's responsibility to maintain the physical aspect of your property but I think that it is probably your responsibility to remove the snow from your roof if it is a problem, if the building is well maintained though snow on your roof should not be a problem. Your kitchen needs cleaning, your bath plug is full of your hair or your garden needs weeding do you call the Landlord then? I thought not. It is definitely your responsibility to continue the day to day up-keep and maintenance of the property when you rent. If the roof might fall in because of the snow then the building is not fit for habitation so run away fast.

Wont it just melt off soon? Then no one has to do it! But I would assume that it would be the renters responsability because they are living there at the moment unless the landlord does the landscaping mowing and such then I would say that kinda goes along with it

don't be lazy and do it yourself...WTF!!! i doubt that they have to do that...i mean if something was wrong with the roof then yea they would have to fix it...but SNOW do it yourself..or pay someone to do it...

Who determines when the snow needs to be shoveled?

I have 40 rentals in No-Cal and at no time has there ever been an issue with the snow or its removal.
The downspouts handle the water removal and snow that would build up would only be a problem if it broke the rain gutters, and I've never had that happen to me or my tenants.
There are some things that you just handle yourself and let nature handle the rest.
If damage happens because of the downpour, that is the responsibility of the LL and their insurance companies.
Try to be a proactive tenant and not one to try and look for the responsibilities of the LL...there are better things to concentrate on.

That responsibility is the owner's. Would you REALLY want tenants up on the roof with you as the owner ? What if one falls off and breaks his neck and is a quadriplegic for life. Stop to think about what you're asking here.

A lawsuit against you if you REQUIRED a tenant to do that maintenance would put you into bankruptcy.

Um, I would think it would be his responsibility since he's the owner of the house, however if you supposed to keep it in shape it might be your responsibility

It seems to me that it would be the responsibility of the owner of the building. If the renter got up there and fell off, it would cost the owner dearly.

think about it -- you own the roof. If it fails, you no longer receive rent and tenant has a fine argument that his goods were injured by your roof failure.

besides -- you do not want tenant up on the roof shoveling snow. if he slips and falls, you will be sued for his injuries and loss of wages.
