The law may be different in New Jersey. But, basically a landlord must give a tenant 30-day notice for a rent increase of 10% or less, and 60 days for more than 10% increase. If you have a lease, the landlord cannot increase the rent until the end of the lease term. If you're month-to-month, the 30/60-day rule applies at any time.
Once you have been notified of the rent increase, you must then respond immediately that you intend on vacating the property or accepting the rent increase. From the time you indicate your intent to vacate, you then owe 30 days rent from that point, regardless of how soon you actually move out. |

Well some can it depends on what it says in your lease. I would read it thouroughly through, In my apt complex it says they can theres some stipulations in there though. I would take your lease to a lawyer and have them take a look at it. Usually its free if they just look at it. Like a free consultation. Dont pay it unless you know for sure the legalitys of it. |

Every state has laws regarding raising the rent...Most say the landlord has to give at least a month's notice...look up your laws, if the landlord is still trying to raise the rent without notice you should be able to take them to court |

Do you have a lease? Some towns have rent controls but if you have no lease or your lease has expired and you are negotiating a new lease then, yes the landlord can raise the rent. |

You need to check the contract that you signed when you started renting. If it says in the contract that he may do this then you can't really do anything about it. But, if you agreed on $1000/month and now he is trying to change it then he can't do it. |

Not that I know of. The place that I'm living in now gave out a notice in April 2008 saying that rent would be increasing in April 2009.. now that's a decent warning!
It would be the same as you and your roommates moving out without giving the landlord any notice. I would contact your local tenant's board if your landlord doesn't wait to increase your rent.. there must be a minimum amount of time that they should give you before you actually have to pay a higher price. |

He can if it is the end of your lease, however, in some states he can also raise it if property taxes go up. Some other taxes or city ordinance changes can change that as well. |

A landlord can raise the rent anywhere as long as they let you know this before you start renting from them. If you signed a lease or something it may be in there in fine print. |

it is in the contract you signed.
It has to occur at the end of your contracted lease period.
So if you leased the apartment for one year, and that year is over, then they can raise the rent. They also have to offer you entry to the new lease at the same/lower/higher rent rate ... rent rates never drop, I'm just putting it in there on the off chance something went wrong and they think that you are going to leave.
So essentially the way to do it is... stick to the lease terms.
They say you pay 1000 per month for one year, you pay that amount. If you go over the year without signing the contract again, then your landlord isn't following procedure. He can only ask you to pay more if he draws up a new contract...
