In Urgent need to Break a Apartment lease..pls help?
We got a nice deal for a house, and have to break our apt lease for sure. We just signed a contract for 9months, what is the easiest way out and with no loss to us.
Pls suggest ur BEST ideas.

Be honest with them, they will be more likely to work with you. Unfortunately, most apartment complexes have costly break-lease clauses, and are not likely to let you off the hook. Depending on their policies, you may be able to find someone to sublease (take over your lease). Check with them first, because some places do not allow it. And if that doesn't work, see if you can get your seller to pay the break-lease fee in the closing costs or something. In my area, especially with new construction, the builder will pay the break-lease fee in order to sell a home. It's worth a shot!

It doesn't matter what you tell them they will have to enforce the policies set forth by their corporate office. Unfortunately for you you will be responsible for the termination fee unless the lease states otherwise. I would read the lease and ask the office if you have any questions.

Ok...that isn't a valid reason to break a lease OR an emergency.

You went shopping for a home when you knew you were under a lease...that is YOUR choice.

You need to ask them what you need to do to break the lease, and expect to pay all charges associated with it.

Don't expect the landlord to foot the bill because you want to move...landlord's have bills too.

If you can find them a replacement tenant that is acceptable to them, they should not have a problem allowing you out of your lease.

All your landlord really cares about is the rental income, they don't really care if it comes from you or from someone else.

Unless the landlord is awefully benevolent you are going to have to pay some serious moola to get out of your lease. I'd suggest that you simply sublease the aptmt for the time you currently have left. Even offer up a discount on the aptmt if you have to. Most of the time the landlords only care about the rental payment and not so much where it comes from and who the leasee is, unless you live in a more exclusive development then you will most certainly have to meet the tenant requirements.

Would it be possible to do some hunting and find someone (responsible, that your landlord would want to live with) to take over your lease for you? That way in the end you get to move out and the landlord still gets paid =)

From a property manager in Texas:
Doesnt matter what you tell them , lie or not, they dont care about sob stories, they have to enforce the legally biding lease agreement that you signed so you are bound to it, if they bent rules for you then they would have to for everyone or they can get into severe trouble with Fair Housing. So you give them in writing, your intent to vacate notice, some require 30 days some 60 days ahead of time. Read the lease. You will have to pay the reletting fee or some places call it other thing like buy out fee etc.... you also have to pay thru your notice. Most companies DO NOT let you lease it out to someone else to avoid the fees. Sorry but there is no way to get out of a lease cheaply but if you pay all the fees and leave your notice as required then it DOES NOT reflect badly on your credit or rent report as long as you go by the lease. And keep in mind also that when your mortgage company goes to look at your rental history, the property will have to tell them that you broke your lease BUT its okay if you broke it the RIGHT WAY, just dont leave owing money as it will go on credit. And dont forget to clean it too when you leave. Good Luck and sometimes its cheaper to just wait till end of lease. So the house may not be a good deal afterall since you gotta pay so much to the apts first, sorry.

First, You should tell your landlord, then send him a certified lette stating when you will be moving out. I believe you have to give 30 days notice. Or whichever is stated in your lease. If you don't they could take you to court and you would have to pay it anyway.
