The Therapist | Is Renter liable for damages? |
California:
I was renting to someone who didn't regularly clean the house including the bathrooms and kitchen. One of the bathroom shower faucets began to drip but never told me. As a result of the constant dripping, it formed rust and lime that damaged the faucet and the tub. Are they liable for these damages due to their negligence in informing of the drip?
If they would have informed me of the drip, the drip would have gotten fixed and the tub would not have gotten stained or the faucets damaged over the course of 1+ year of constant dripping. Additional Details Sounds like I'm getting mixed answers here. It's beyond CLR. That specific repair costed $600 but I have decided to charge her only $200 of it.
By the way...We would make quarterly calls and reaffirmed her that if any repairs needed to be made to let us know. She hid this from us until the day I went to pick up the keys.

Honestly this is a gray area. I could see you going to court and winning or losing - it may just depend on the judge you got. I really think you are in the right as her not telling you about this didn't give you a chance to avoid the cost. On the other hand she didn't really hide it from you, she probably just thought it was so minor it never occurred to her to tell you, and its so minor (telling you about a drip) that I could see a judge just saying you have to foot the cost regardless.
Still, I think charging her $200 out of $600 is pretty fair (maybe even nice). Just explain it to her, she probably won't be happy but I think you have a valid argument. |

Cali renter here: I think the only thing you could do is keep the deposit. It seems like they would have gotten tired of hearing the water run.
The owner of my building has running sprinkler in the front that no one has told him about. If he wasn't such a money hungry landlord we-I would have called him a long time ago. He only "remembers" to call when the rent is due. But don't let something be wrong with the place. He will forget for months even with the 3 reminder calls. If you have renters you take care of they will take care of you-well your property.

No. It is the price of doing business. Go to a hardware store and get some CLR to remove the stains. |

I would say that it would be a 50/50 split. They would be repairing it for you. Can you prove that the leak was not there when they moved in. If they gave a deposit just hold enough to repair the problem or at least half. Good Luck. |
