If he pushed it, you'd have a problem, because you misrepresented your age, effectively giving up the protection you now want. But, if you tell him that you weren't of age, prove it, and ask him to release you, it's possible he might just to avoid the hassle. Worth a try. |

If it is binding, a sublease means that you are renting it to someone else. I wouldn't suggest it, however. |

In general, contracts with minors are voidable at the option of the minor.
However, there are two common exceptions that appear to apply in your case.
1. Courts will often enforce contracts for "necessities." Housing is usually a necessity, especially if the minor is emancipated.
2. A minor must disaffirm the contract before turning 18, or within a reasonable time after turning 18. If you turn 18, and continue performing the terms of the contract, you will effectively "ratify" the contract, and it then becomes completely enforceable. How soon after your 18th birthday you must act to disaffirm the contract is up to the discretion of the judge. There is no fixed time frame. |

At 17, you were not old enough to sign a contract and be held accountable for it. It was up to the leasing agent to verify all your info, including age, credit, SSN#, employment etc. Sounds like they could eat this one. |

I can't give you any legal advice, but my guess is that it wouldn't be legally binding (not sure though).
What I do know is if you had a co-signer who was an adult, you might want to speak to them before you break the lease, as the rental owner can take them to court even if you were minor when you signed. |

You can probably get out of the lease that way, but why?
Think about it. If the apartment is that bad, there are legal remedies, the right way to do things.
A sublease can only be done if it is approved in the existing lease. |

This is a tricky question in some states it would be considered legal at age 16. There should be a landlord/tenant court help line where they can answer this type of question. Good luck! |
