Is a land lord allowed to enter your apartment when ever he feels like it?
My land lord enters my apartment when I'm not home and he turns the heat up if he feels that it is to low. I live on the third floor with an insurence company and a flower shop and another apt. below me. Heat rises, I keep the apart. set at 55 and all water pipes run through the other buidings and up to my apt. He keeps saying the pipes in the apt will freez. Here the catch at 55 degrees I pay a gas bill of over a hundred dollars and when he turns it up to 70 my bill is over $200 and some dollars a month. It is only a small 2 bedroom apt and I do not pay for hot water I do belive Im paying to heat somthing other then my apt. Is there any action I can take

The rules with respect to when and under what circumstances a landlord can enter rental property vary from State to State and even County to County and City to City in some cases.

With respect to the heat issue, the only issue that I can think of would be mold. When you shower or bathe in the morning you often get warm moist air in the apartment.

If you leave the temperature at 55 degrees when you leave, the moisture in the air will condense on the cold surfaces. In some cases that can cause mold to grow.

I would talk with your landlord and ask him to give you more information in writing why he insists that the temperature in your apartment be kept at 70 degrees even when you are away.

I recommend that you consider moving to another property where your landlord is more agreeable.

In short, a landlord has the right to enter your apartment without your permission only in case of emergency.
As for the "temperature problem," something is wrong here. The pipes will not freeze at 55 degrees (water freezes at 32 degrees.)
55 might be too low for your comfort, but it's your business, not his.
Unless the landlord can prove that turning the heat up in your place is an emergency, just tell him to stop doing it or complain to your local housing authority.

average your heating bills to your usage and reduce your rental payments to the LL by that amt, and if he squeals, and wants to to evict, let him take you to court as he will get a tongue lashing from the judge for the illegal entry that you will mention.

Look at your lease if you have one. Often it allows the landlord to come in once a month.

This is suspicious. Pipes won't freeze at 55 degrees. The county building department could pull up a floor plan of the property and you might want to look at it for ideas on what else he could be heating. A heating contractor might have some ideas, if you know one. A friendly neighbor might know something too. I can think of a number of landlords who "add-on" to the routing of electricity and water. Check it out. If he has been doing that you can recoup your expenses through small claims court.

Depends on what your lease says. It is his property not yours and if keeping the temperature at a certain level is required to avoid frozen pipes you bet he can protect his investment.

If you don't like it MOVE!! Read your lease and don't move to someplace you can't live with the restrictions and agreement. Or buy your own place and do what you please and live with the consequences of your actions.

As someone else said, you're not keeping the temperature at whatever he wants it to be to not freeze the pipes. You should consult the lease and see what it says about that. If it says nothing, then you've got a case. If not, then you could get him in trouble for entering without your consent, but you are violating the rules too.
