Yes, the landlord should give you a written 30 day notice, since you are on an oral agreement. If you want to move, I would suggest that you give written notice as well.

not sure where you are but I nkow in Idaho I agreed to let a friend live with me no real lease just they could stay for awhile and I had to give 30 day notice when I was ready for them to leave and they didnt want to. (cops were involved and that was the law here)

Get your lease in writing. In many states without a written lease, you have very little control over your rental situation. Also if you gave your landlord a security desposit, without a lease you have no evidence of this.

The landlord is required to give you a 30 day notice if they at any time decide to not rent to you next month. This is in essence what a month to month agreement is. Legally they can ask to leave at any time, you can buy some time if necessary by making them go thru the court to evict you-just be sure to pay all you owe the landlord before you go to court.

Your best bet is to have a written lease stating all the terms you and the landlord have agreed to - it can state that it is a month to month lease or basically a statement of facts related to your renting. This should state how long you are expecting to rent the place or if it is long term, the amount you pay for rent, utilities, etc's such as lawn mowing or snow shoveling, driveway clearing, garbage removal in a clear and precise way so you know exactly where you stand.

In this way you have a clear statement to show a judge should you ever need too. (for instance to get a deposit back ).

i am a leasing consultant as far as word of mouth, i would not do anything unless it is in writing not only to protect myself but also the tenant. the only reason i can see that you didnt recieve it in writing is maybe your lease xpired and you did not phone or renew so it automatically went mtm, in our case if that happens it is an automatic $30 increase for mtm. and yes everything is in writing and yes everything is by law 30 days notice for tenant and office. protect yourself get it in writing or they can file for posession and evict you. i give tenants a 60 day notice that there lease xpires

ORAL agreements are NEVER legal. NEVER EVER!!!
if there is not a signed, written contract between the two of you, then there is nothing stating how long you have to live there
