MICHEAL W | Is a landlord responsible legally for the behaviour of his tenants I have a neighbour from hell? |
|
|

Becci
|
that would depend entirely how you describe 'neighbour from hell' i currently rent a nice little house in the countryside with my fiance, we're a young couple and our neighbours are middled aged with 3 kids.
we've been there for about 3 years now and the neighbours describe us to the landlord as neighbours from hell, in there terms it means -
- blocking their driveway for about 30 seconds (baring in mind they were in the house and werent going anywhere)
- Having 2 parties (for my 21st and new year)
- having a bbq with my family
- friends parking on our grass
- laughing too loudly
It got the point where we couldnt actually breathe without them complaining about us, all based on the fact they didnt like a younger couple living next door to them (obvisouly stereoptyping, we are actually working hard towards our careers and are a very sensible couple)
If they really are neighbours from hell,
- firstly keep a record of everything you feel is disrupting you and evidence if possible (if loud music is being played, record it)
- ring the landlord, and explain your issues
- if the issue isnt dealt with contact citizens advice and see if you have a case, if so write the landlord a formal letter again of your issues and what action you want to be taken and if nothing is done you will be taking them to court
- in the unlikely event of your issues being dealt with then seek legal advice
If your next door neighbours are renting from an agent your problem will probably be dealt with pretty swiftly, but unfortunetly its your word against your neighbours, try asking another residents around you if they are having any problems?
If your dealing with a private landlord they tend not to really be concerned as long as they are getting the money!
It can take a long time for something to get done, my previous neighbour was a violent alcohlic, it took me 10 years to solve the problem, especially if its the council your dealing with!
Hopefully you'll be lucky and your neighbours will be on a short term agreement and if you complain enough when it gets round to reneweing the agreement they wont be accepted!
Good luck!! |

Yes, your neighbour is almost certainly breaking his/her Tenancy Agreement. If you know who the Landlord is, contact them and explain why, unless this tenant starts to behave decently or is evicted, you will start proceedings. No landlord wants that grief. |

In my state, a landlord may be held accountable for damage done by a tenant. You should ask an attorney in your area. |

In the past few years various municipalities in Canada have passed by-laws that address some of these problems, particularly if a rented house is used for illegal activity -- you can report to police and if the tenant is convicted of an offense you can claim civil damages and or the municipality will put stipulations on the house before the owner can rent it out again -- such as cleaning it up -- if the owner does not clean it up the city will and put the costs on to the taxes, if taxes are not paid the property can be sold by the municipality. |

Wow! My family has been there and been through that many times the years we have lived in the same place. Do you have a lease, and do they? We are always told to go to the neighbor peaceably to let our concerns known and asking them if we are doing anything that may be problematic to them. We were use to not having a neighbor upstairs for 2-3 years. We were into the habit of staying up late and having the tv way up loud as if we forgot we would not have another neighbor. Someone eventually moved in who happened to have a brother and sister of Asian descent studying to become doctors. At first I was upset as the female knocked on my door who knew English not so well saying to turn down my tv. I wanted to get angry and thought about retailiation! Then myself and my family realized we were contributing to it. I'm not saying you are, but it happens. So, first line of defense is to try to attempt a non-threatening converstaion with peaceable words on your end. If that doesn't work, go to the landlord. It would be helpful if you have documentation, such as a camcorder, cell phone with pictures, and witnesses who have visited and can vouch for what has been going on. Our last resort amongst neighbors was everytime one neighbor had loud arguments, loud music, or parties after midnight, we called the police anonymously or told the local police who we are. Some places have security officers to deal with the mild situations. Usually we are told to just call the cops for unaccceptable behavior. I hope if you have fallen in love with your place as we have, that you don't have to move. But that is your final option. I tell people if they are going to rent somewhere, check out the neighborhood well, especially evenings, and of courses the weekends to see for yourself what to expect. Lastly, you may want to consider a home of your own with space from neighbors and not a subdivision that may have rules you don't like or find unacceptable, such as what you can and cannot put on your property or what you can or cannot do on your property, and fees to live there. |

No, Landlords aren't, but they are a brilliant place to start as they will always want to keep the neighbours sweet.
Landlord then council, but first talk to the neighbours if you can as conflict is never good.
It is hard, and you shouldn't really have to, but going over and quitely talking is always the best step in resolving things like these.
The council and the police are slow to act so this could get worse before it gets better.
The landlord may scarethem into being behaved |

YES! Write a letter to the landlord explaining all ur problems, he or she should address this asap with ur neighbors, if the problem continues call the police or if ur property has a service that patrols the police nor the patrol service will tell the neighbors who called, make sure u request this, then follow thru with another letter mail them certified return receipt requested and keep copies of ur letters, u now have documentation from u and the police or patrol service, if the landlord does nothing I would request a face to face meeting with the landlord, most good landlords do not want to lose good residents over bad ones, he or she will send notices to ur neighbors if they dont comply the landlord in most instances will file eviction, but remember u have to understand the eviction process in most states takes at least 30 days and in others longer, but ur landlord would be doing all that is possible. If ur landlord does nothing u should see what ur options r some leases offer a way out give 30 day notice, of course u pay for the 30 days u r there and if its on ur lease u maybe able to get out of the remaining months by paying what is called cost of reletting a % of 1 months rent due at move out. I am sorry to say that if u should just move even though u have a legi t reason u will more than likley ruin ur rental history, if u only have a couple of months left on ur lease u may want to send a 30 nday wriiten notice to move along with your written complaints. Hope this has helped, HAPPY NEW YEAR! |
