Is it against the law for the rental office to place an exposed late notice on your door?
Someone saw my late notice for rent and said that the late notice must be inside an envelope or at least presented in a way that is discreet and not so easy for anyone to read. Please advise.

It can not have your name on it anywhere. (That is your privacy! That would be like if someone called the leasing office and asked if you lived there and what apartment number you lived in and the leasing office gave out that information) If it just has your apartment number and how much you owe then they can tape it on the front of your door on neon paper if they wish. (Being a property manager I have done that... Yes it makes people mad, but they pay!)


By the way, If you were the only one that they did that to that and there were more people that was late then that would be against Fair Housing Laws (they have to treat everyone equal!)

One more thing... if it is a notice to vacate they have 3 options for it to be delivered:

1) Posted on the INSIDE of your apartment in a place that is noticeable (normally on the front door)

2) Hand deliver it to someone over the age of 18

3) Place it on the outside of your door AND mail it to your apartment.

actually its a required part of the eviction process - if the landlord does not properly serve notice, he can't start the eviction process. The law in my state (az) requires notice taped to the door, notice sent certified, and hand-delivered....if I don't do it that way exactly, then I can't even start the eviction process.

He did that because if you don't pay, he doesn't want to wait to find out if you are going to pay.

it is not against the law to post both a rent late notice or a eviction paper on the door exposed.
most landlords are nicer than what happened to you..i agree with you that is would be better business to put the notice in a envelope,but there is nothing you can do about it....

Not at all. Your lease should stipulate all requirements for notice from landlord to tenant. However posting a late notice on your door is the landlord's right in order to collect what is due them. Take heart though, we've all been late paying our bills from time to time.

No. It is a sloppy and embarassing way to do it but he is rely on the embarassasment to prevent late payments later.

No, I don't believe it's against any law. It's just a humilition tactic they're using. They figure by humiliating you like this in front of your neighbors, you won't be late ever again.

Nope not illegal, because it's true. If it were untrue yes you could do something but it's not. Just pay your rent or move out. If he did that it's probly because he's upset with you. If you can'y afford to pay the whole month right away at least pay part of it, and tell him you'll bring the rest as soon as you have it. That way he doesn't have to feel like he needs to chase you down in order to collect the rent which is lawfully his. Landloards appreciate communication and most of us are nice people who understand when something comes up and you may have trouble for a month or two. You need to be honest and talk to him about your situation
