Is this discrimination???? I know someone who recently became a landlord, but refuses to rent to friends or relatives even though they have excellent credit and previous rental references. (never been evicted or late on rent and has been employed with the same company for 15 years) Is discrimination limited to race, religion and sexual issues?

I agree with all of you that it's NOT a good idea to rent to friends and/or relatives...same reason that you don't borrow money to friends and/or relatives. It has just never been clear to me where the discrimination law and personal preference lines are. |

In general, in private relationships, people are free to choose who they want to deal with. Non discrimination legislation limits this freedom, prescribing that people may not (except for extraordinary circumstances) base their preference on certain specific grounds as religion, race, sex, sexual preference, age. So yes, the legal prohibition of discrimination is limited to these grounds only. |

That's not discrimination, that's good business sense. I wouldn't rent to friends or relatives either because it could get real messy if anything goes wrong. There's more than just possible late payments involved, there's upkeep on the place. |

Discrimination is limited to what is (or should be) a "Protected Class". Family does not, necessarily, fall into this category. Besides, do the family members to whom this person will not rent plan to sue for discrimination? Is the rental worth breaking up the family?
There would have to be something more for this to rise to the level of something worth litigating. |

This is not discrimination, just a policy. Many companies have policies of not hiring friends or relatives of employees, it kinda makes sense due to complications that could arise. I don't think it is a bad idea myself, especially if you want to remain friends with them. |

No, it's good practice. There will inevitably be a problem somewhere down the line. It's best to never do business of any kind with friends or family. |

Discrimination in the way you seem to be trying to apply it applies to protected classes of people. Discrimination in the illegal sense applies to race, religion, marital status, etc.
Refusing to rent to friends and family is another type of discrimination, a smart one in my opinion, but not an illegal type of discrimination. |

how many units does he own? not until a landlord owns over x number of units do they have to comply with discrimination laws. Under this number, the landlord can discriminate for any reason. I don't know what that number is... |

Your use of terms is what confuses you. Discrimination is not illegal. Improper discrimination based on factors outlined in the law is. Under federal law, those factors are race, religion, national origin, and age. Some states have more restrictive statutes which include marital status and sexual orientation. Even if the family and friends fall into one of those classes, the reason for denying them would be the relationship and that would be allowed. |

don't accuse unless you really know the reason
ask the landlord why, and if he doesn't provide a valid reason, i guess this can be resolved in some landlords tenants board law or something |
