My partner and i are looking to move in together, however we do not have the money for a mortgage right now (deposit),his mother is going to lend us 60k. We are looking for a 120k house. Then we will only need to pay a 60k mortgage over 15 years and then pay his mother back 50% of whatever the value of the house is at the time.
We will be sharing all costs 50/50. My partner wants the house is his and his mums name. He says once we have paid off the 60k mortgage and his mum then he will transfer his mums name to mine on the papers.The only problem is my partner wants me to fill out a rent book each month. Which i think is unfair seeing as i will be paying half the mortgage?
I am a little concerned, as i am not sure where i stand legally with this, surely if we split before the mortgage is paid off then i end up with nothing?
Can anyone help!

When i ask why my name cannot be on the mortgage he says that a mortage cannot go 50,25,25.(;percent). Im guessing that by filling out a rent book, legally it would jus tmake me a tenant, regardless if i have been paying half! |

you are correct in thinking you should be concerned, your best idea will be to get some legal advice as your partner sounds like he is trying to take you to the cleaners and you could very well end up with nothing especially if you have nothing in a legal manner. and if he starts moaning that you distrust him then you could also say the same to him |

VERY smart partner and probably the exact advice an Atty would give him. Are YOU putting any money into the transaction?
Technically you are just a tenant and this is the advice I would certainly give him/her. You could walk away with an ownership in the house without putting a dime into it, until you do. |

In England/Wales, you wouldn't even be a tenant - when the landlord (BF) lives in the same property you can only be an excluded occupier - with virtually no rights.
You need to get your own solicitor to protect your interests.
With regard to 'getting nothing' if you split, that is not technically true because you will have had X years of housing for an amount (50% of a reduced mortgage) considerably less than a commercial rent agreement.
A rent book proves nothing - most tenancies don't need them in law (although, as I said, this wouldn't be a tenancy). |

If you have a rent book then you are, in effect, stating that you aren't a part-owner of the property and are signing away your rights to any property settlement if you split up. Legally a common law wife has very little recourse anyway when it comes to claiming a share of a property - if you agree to the rent book idea then you have absolutely no recourse at all. I don't like the idea! You will be paying off part of his mortgage but would never be a part-owner.
Wherever you live you would have to pay something towards rent or a mortgage, but I dislike the idea that you are paying rent and will have nothing to show for it at a later date, whilst he is using your money to invest in a property that could prove to be a good investment for him in the future.
If he is fair then the best way do do this would surely be to either put your name on the mortgage as a part-owner (I'm sure this would be possible, despite what your partner says) or to have some sort of legal document drawn up to confirm that you are part owner.
The more I think about this, the worse it becomes! I hate to say this, but I feel that he is (at best) covering his own back or (at worst) taking you for a ride! He isn't just protecting his Mother's money - he is protecting his money too and making damned sure that you are paying towards something that you will never have a share of. If he won't go and see a solicitor, with you, then I'm sorry but I wouldn't be going to live with him. Make him prove that he isn't manipulating you into investing your money in him! |
