Is it illegal for a condo association to post a listing of the tenants who are late paying their fees?
the condo's association treasurer posts a listing of the tenants who are late paying their monthly fees and next to the name it shows how much each tenant owes. The lady has a definite grudge out for some of us and it seems so demeaning to post our business like that. She posts it right above our mailboxes for all to see. I would like to confront her but I need a defense before I take the sign down. thanks for your help.

I would not think so. The rest of the residences should know who is not paying their fair share of the expenses. Those not paying may cause those that do to further support them with increased fees.

The only possible defense would be that it is incorrect, that you do pay your share of the community expenses.

If its in the convents of the association that you agreed to then no. best thing to do is get on the board and change the rules. If not then pay your bills on time and live with it.

I would NEVER live where there is a HOA/association. Our house does not have one and we bought it for that reason.

Nope. The financial books of a Condo Association are to the open for inspection by any member of said association.

Public shaming is a wonderful tool that helps remind people to pay on time or be shamed in a public forum.

That being said, there is a perfectly bulletproof defense against this degrading activity:

Presumably you're talking about HOA fees. HOAs are private, so they can pretty much do what they want.

i'd say the best defense is to pay your fees and rent on time. i'm sure in the by-laws of your condo assoc. it says that they are allowed to do this.

I'm not aware of any law specifically protecting such information. If the information was false, you could possible sue for defamation.

All members of the HOA have an interest in knowing if the dues are being paid on time, so every HOA member could conceiveably have access to the information.

If you don't like what _your_ treasurer does, then bring up the issue at the HOA meeting or find a candidate to run against her. Maybe you and the other late payors could unite and vote against her.

It isn't illegal, but it is a horrible thing to do. All it does is create problems for the people whose names are on the list. It doesn't get the dues paid any quicker, either.

Since they can do it, the individuals can also sue them if they happen to have their property damaged by "vigilantees".

It's not they do it in my building, it's so disgustiing and rude
it falls under public notice, thats how they get away with it
my suggestion, if the lady is fat create a list of tenenats with their weights , put here name on the bottom and exagerrate, or age, maybe IQ, whatever, then post it underneath that

In Florida it is, but varied state by state. Probably if they are doing it, it is legal. HOA's can be stupid, but not THAT stupid.
