Andy G | Is it illegal to destroy my previous house owners mail? |
It's been a year and a half since our home's previous owners moved out and we are still receiving a lot of their mail. Can I just throw it in the bin? What are my legal obligations?

In the US it is illegal. You give it to the post office and they deal with it. Just put it back in the outgoing mail and write "no such person at address" on the envelope. |

I'm not saying I know the law about it, BUT if you keep it and it's from a mailing house, then the post will just keep coming. By sending it back, the mailing house has to remove that person from the list or it can be considered harrassment of you because you didn't ask for it. You could also use the sites below to register the previous occupant to stop some of their mail coming to your home. If you get unwanted mail in your name, you can stop these, too, by making your preferences known on the sites below, if you are in the UK (the USA has the same type of sites as do most countries, so run a search for the Direct Marketing Association--I used to live in the USA and now I live in England so I've used both).
Personally, I'd just stick theirs back in the post next time I went to the post office in case they are being hunted by creditors or legal agencies who might show up at my door asking why I didn't return the letters when they weren't mine.

Interfering with the mail: general
(1) A person commits an offence if, without reasonable excuse, he—
(a) intentionally delays or opens a postal packet in the course of its transmission by post, or
(b) intentionally opens a mail-bag.
(2) Subsections (2) to (5) of section 83 apply to subsection (1) above as they apply to subsection (1) of that section.
(3) A person commits an offence if, intending to act to a person’s detriment and without reasonable excuse, he opens a postal packet which he knows or reasonably suspects has been incorrectly delivered to him.
(4) Subsections (2) and (3) of section 83 (so far as they relate to the opening of postal packets) apply to subsection (3) above as they apply to subsection (1) of that section.
(5) A person who commits an offence under subsection (1) or (3) shall be liable on summary conviction to a fine not exceeding level 5 on the standard scale or to imprisonment for a term not exceeding six months or to both. |

Personally i would just write "not known at this address" or "return to sender"and put it back into the post box. Most letters now days have the senders address on the back of the envelopes, so let the companies find the last owners. |

Its not illegal to take it out of the box. Its only illegal when you open it. so go ahead and throw it away or you can write moved on it and drop it back in your box with red flag up. |
