Is it legal for a landlord to do this?
My lease expires Dec 31, 2008. At previous expirations, three months before hand my landlord would ask me to let them know if I intended to renew or not, but I did not have sign my new lease before the old expired. I must give 30 days notice when I move out, whether or not my lease is expiring.

Today, I got a notice from my landlord that they are raising my rent almost $200 in January and that I must renew my lease by Oct. 15 or I will have to move out. Currently, the rent is $550, and they are raising it to $720.

Most of the rentals in my area (Rexburg, Idaho) have waiting lists and won't be able to let me know if they can give us an apartment until the end of Nov, beginning of Dec. So I feel like my current landlord is trying to rush us so as to trap us in this higher rent (which is now a ridiculous amount for the area - most apartments are much nicer and cheaper than $700, the only reason we stayed in this dump was because it was cheaper).

If I sign the new lease to start Jan 1, but then move before January anyways, they will keep my $300 security deposit.
Additional Details
I know raising the rent is legal. I'm more concerned with, is it legal for them to try and force me to renew my contract almost 3 months before it expires?

$300 one time payment is not that much compared to a monthly increase of $200, which is $2,400 per year. I suggest that you sign the new lease and look for another apartment. And if you find a cheaper place. Then let your present landlord keep the $300 and move to the cheaper place.

For $300 you will basically buy an option of being able to decide whether to stay or to move.

Your landlord main goal is to get the highest rent that he can find someone to pay. Your goal is to get as nice of place as you can for as little as you can. Your landlord is justified in what he/she is doing.

As you are in meeting your goals.

This could require you to move. This can happen again to you as long as you are renting.

Yes, the landlord can charge a thousand dollars more if they want. Once your lease is up they can do as they please. Nothing out of the ordinary there.

You had better check into this:

The landlord can legally hold you liable for the rent until either the lease expires or a replacement tenant is found. It would be highly unlikely that the landlord would limit himself to only a $300.00 penalty for a broken lease.

From what you've explained it sounds like you are legally bound. You mention that, if you sign the lease and then move out early, you will lose your $300 security deposit - how long will it take you to re-coop that amount in another apartment (if you find one that is cheaper)?

I don't think this is legal and I didn't know you have to give a notice,when you move out> I thought you had thirty days to move out when you last paid rent for the month or at least you can't get kicked out for 30 days after you paid for the month. You need to ask a lawyer for advice It might be free advice. The landlord is rushing you don't sign a new lease with the increase> I don't think this is right my opinion I just don't think you should sign anything. Ask a lawyer for some free advice. I got free advice with and old deed to our house.

Yes, it is legal for the landlord to raise the rent at the end of your contract, unless there is rent control in the city that you live in. But as far as trying to make you renew your lease so soon before it's up is. You signed a lease for a full year, and apparantly, the landlord isn't honoring the contract that was signed when you first moved in. You really should find out why they are pressuring you, and if it gets to be a bigger problem, seek legal help... good luck

It is legal but I'd certainly not do it. Call their bluff. Go ahead and look for another property in the meantime. At the very least you should get more for your increased rent than you have now.

I'm in Canada and we have a law that says that landlords can only raise the rent by like 3 % per year. Actually I can't remember the exact percentage but it is going from 910 per month to 921. Very small compared to yours. I would assume that there has to be some sort of guideline where you are as well. There must be a tenancy board you can contact to find out. You need to contact them and find out exactly what you can do. If your landlord catches you in some loop hole that says your a new tenant then maybe they could raise it that much. I know they can pretty well raise it to whatever they want as long as your a new tenant so I'd be careful as to what your lease rules dictate as far as defining you as a new tenant because you did not renew your lease.
