Irish Red | Is it legal for a landlord to enter your home on a regular basis to see if it is clean? |
I have rented my duplex for the past 2 years. I knew the manager came in to do bug spraying and make sure I have not destroyed the home and that was done quarterly. Last week the manager left me a note stating she would now come into my home bi -weekly because she considered it "dirty" I work full time and have a 3 year old of course my home is not spotless. She reported I had clothes on my bedroom floor, needed to vacuum and clean my fridge etc.. When I called her and said I dont want you in my home inspecting it she told me I dont have a choice because the property is a tax write off. It is a duplex for low income single parents and I pay rent every month. I read the lease which no where states that someone can come in to inspect for "cleanliness" I now am stressed out because my idea of clean is differnt from hers. Is this legal? She tells me I have no choice. Thank you |

Unless it is written into your lease, then no, it isn't legal. If she is going to do that, it MUST be done with your permission, and with 24 hour notice. You are also within your rights to insist that you be present for this. Call a local housing authority, and until then, put a lock on your door. You are also within your rights to contact local police and file a 'breaking and entering' report against her. Once your apartment has been rented to you, it is no longer within her rights to come and go as she pleases- it is your property. Tax write offs have nothing to do with it. |

It sounds like what she is doing is mean, but I don't think it is illegal. She is giving you notice that she will be coming in to inspect, and I don't think that there are restrictions on how often they can do this. I'm not sure why she cares about things like clothes on the floor and a dirty fridge, but she might just be trying to get rid of you. I know you are busy, but it might actually help to encourage you to take the few seconds to throw the clothes in the basket and the rotten cheese in the garbage, and then you will feel happier in your cleaner home. So maybe this is a blessing in disguise? Good luck. |

Check with your city offices and see if there is a tenant/landlord council. Most cities have some form of this to protect both entities! Good luck and a P.S.-- I wouldn't like that intrusion either! ;-)= |

It depends what laws you have where you live.
Bi-weekly seems a bit much. Once or twice a year is more reasonable. When I lived in an apartment, the landlord inspected once a year, as he did all the tenants, and with plenty or prior warning and flexibility. |

this is the simplest way to find out call the police and tell them that your LL is going into your apt uninvited, what he is doing is a criminal act they will warn and or arrest him he has no right o enter uninvited no matter what the lease says. I know I did the same thing when I tried to get some tenants out I opened the door they looked at me dialed 911 and I was in the back of a cop car in about 10 minutes |

depends on what state you are in. there are laws to govern how landlords should behave. arm yourself with knowledge - you said you work and have a child - maybe there is some sort of legal aid for single low income folks. at the very least it appears she is violating your privacy & the "no choice" - this is America, you always have some sort of choice. and if she said that the building is a tax write off - well i my humble opinion that just makes her a "Slum Lord". educate yourself on your rights as a renter for what ever state you are in. ever think of changing the locks or maybe have a friend house sit while your out & snap a pic of her when she enters as proof she enters at will - if you cannot have a dog - then maybe boobie-trap house (not so she is injured)with a camera, so you have proof that she enters while you are out. sounds like she should get a life of her own! Do Not let her intimadate you - also check with other tenents - see if she is doing this to all in her building - if so ban together and make a formal complaint - to the OWNER of building - as you said she's only the manager. my best to you & good luck! :) |

i wasn't aware that this rule varied by state, but every state i've lived, (and even in out of this country!) the landlord is required by law to give 24 hr notice when they enter your home, each time they plan to enter it.. .
what she is doing sounds ridiculous. she's not your mom.. pfft. |

Agree with The Florida Landlord and Tenant Act, this are some of the landlord obligations:
Mantein rented dwelling unit in a condition that meets all building, housing and health codes, such as, Provide extermination service, provide garbage receptacles and pick up, etc.
LANDLORD'S, ACCESS TO PREMISES.
A tenant may not unreasonably withhold consent for landlord to enter rented premises from time to time. |

She's going to be pretty busy with the bi-weekly, but as a landlord she can come as often as she wants as long as you get 24 hour notice of her coming. It's her carpet and refrigerator and she has a right to know if it's being taken care of |

Generally speaking, yes she can because you agreed to it in the lease, however you can make it very difficult for her. Insist that you be present when she does this and make sure you are not available most of the time. You could also offer to let her clean your apartment if she finds it not up to her standards(I am being sarcastic but it is fun to do). If push comes to shove she would probably lose in a courtroom but I would not want to see it go that far. She does have to give you prior notice of her intent to inspect(usually 24 hrs.). If she shows up unannounced and forces her way in you could call the police and charge her with trespassing--again that is an extreme measure. She does sound like a control freak. |
