I recently put a downpayment for an apartment and the landlord told me in order to sign the lease I need to bring a photocopy of my driver's license and social security card. Is that even legal? I don't feel like she needs to have a photocopy of that information.
I also have been sick recently and am just getting out of the hospital. I haven't been able to move in until now. She also wants a copy of my discharge papers from the hospital. Is it legal for her to ask for these things.
I have no desire to move into her apartment anymore, but I just want to know whether a landlord could ask for such items from a tenant. |

Certain government agencies require BY LAW your SSN. Examples: the IRS, DMV, your bank. If she can cite the law and the reason why she needs it, and how her needs require it (which she probably can't), she doesn't legally need it. She probably wants to run a credit check / background check on you, which is why she wants it.
Your hospital discharge papers are protected healthcare information protected by law. She does not need to see them according to the law. |

Yes, this is legal. She can't do anything with the copy that she can't do with just the numbers. She is verifying identity.
I have once asked for this, as the credit check indicated more then one person was using the SSN. The renter had no idea and was grateful that I caught their ID theft early and pointed it out.
There is no legal reason for the discharge papers. She may be worried about your future ability to pay rent or maybe she is simply thinking she could offer you some hep and is trying to determine what she can do to help you. |

I don't believe that she can ask for that information unless she is running a credit check which is legitimate. If you are getting government assistance for rent that may be a reason.
Either way there is no need for a landlord to have a copy of your hospital discharge papers. |

It is entirely legal for a landlord to ask for such copies. If the landlord wants that information as part of her tenant record, she is entitled to same.
However, there are federal laws which require the safekeeping/confidentiality of such information once handed over to someone else. Hopefully the landlord is aware of those laws and follows them to properly secure the information from falling into the wrong hands.
I do not understand why she has asked for your hospital discharge papers. That seems quite out of line. |

He can ask for it and require it, yes.
Federal Law says SSN system was designed for banks, so only banks and the IRS have a right to this info.
However, he can ask for it and require it to rent to you.
The law says he cannot ask for it twice.
I require it as a landlord, if they say "no" I say
"thank you, drive through".
SSN makes it easy to track you down if you turn out to be a deadbeat, and that is WHY we ask for it. |

Since you haven't signed the lease then the landlord should not have taken the property off the market. All you have to do is tell her that you decided not to lease her property after all and please return your "down payment." Is this "down payment" an application fee?
She is within her rights to request your social security number so that she can do a credit check, eviction history and criminal background check. The driver's license photocopy is often required by many property managers and landlords. There is a difference of opinion as to whether this should be a part of the application to lease or a part of the lease signing requirement.
The hospital discharge paperwork is not a normal request. You may want to know why she is asking for it. If it has to do with your ability to return to your job and thus be able to pay the rent then you need to reassure her on that level. |

Except for work related situations (and those are limited), no one else is entitled to know your medical condition. I've never leased but I see no reason why she would need your social except to run a credit check.
Seems she would check your credit before accepting a downpayment. I would move elsewhere. She also may be a nosy busybody. |

Driver's lisence yes. SS# no, you don't have to give that to anyone and as far discharge paper's from a hospital why would she want that. Your right in not wanting to move into her place. Find another. |

Landlords have every right to require a SS# or a Driver's License, but then you certainly have every right not to provide that information or documentation. However, without the SS#, the landlord cannot run a credit check, and the Driver's License at time of application verifies that you are in fact who you claim to be. So if you want to rent property from that landlord it's really up to you. Give the info or go somewhere else. Chances are if they are requiring that info, they will be a better landlord than those who don't, and you will be in a safer environment if it is an apartment because everyone there has been screened. Landlords have no right to someone's medical information unless the applicant is asking for a disability accommodation, and that is clearly defined in HUD regulations in each state. |
