Is it legal for my landlord to charge an extra $300 if the rent isn't paid by the 4th of the month?

Yes it is legal.

But if you get evicted, the judge may find that amount to be unreasonable. In other words, that amount may be "Unenforceable" in court.

The last eviction hearing I went to, the judge knocked down another landlord's late fees to $10/day.

Why don't you get qualified to BUY a house? I just got an FHA approval for a young woman who earns $7.5/hr + OT for a $100,000 house! You can too!

There are lots of homes that are SUPER CHEAP and cleaning up your credit is just a matter of a few months and (hopefully) a few dollars. I

Depends on your state. In Ohio, for example, that would not be legal because it is a penalty charge, which is specifically barred through common law. The reason being is that it is completely out of wack with the amount of damages the landlord suffered on account of you not paying on time.

Frankly, I wouldn't sign that lease on principle alone. But if you did get stuck, check with your state laws...not with the people who are waxing intellectual about this on Yahoo Answers because they saw on TV that any contract you sign means your bound to it by law.

Is it in the lease? or are you on a current month to month?

Your LL put that in the lease to get people to pay rent on time.

When I managed executive suites our standard lease stated that we would charge a $150.00 bounce check charge, the tenants would balk, and I would say, "do you plan on bouncing a check? if not don't worry about it" and they would sign the agreement. It's a scare tactic to make sure that their checks were always good.

Your LL is doing the same thing, yes he can do that he can do what he wants within reason.

Guess the question is "Do you plan on paying your rent late every month? if you don't then don't worry about the $300" If someone balks at the $300 then he wouldn't want them as renters because it means they plan on paying late each month and no one wants that hassle.

If it’s a new lease, of course he can. Your rent is his income. Would you find it acceptable for your employer to pay you late suffer no consequence?

He can legally do it if you sign it giving him permission.

It depends. If this is a new landlord/new apartment yes, he can write it into the lease agreement. If you already rent the apartment and the lease has expired, check the language of the lease regarding terms after expiration. It should have terms there for month-to-month renting and what needs to be done to change the terms.

I would not sign a lease with such excessive late fees.

Your landlord can put any late fee he wants in the lease, but it does not make it legal, conscionable or enforceable.

Unless your rent is $3000.00 per month, the late fee clause could be viewed as excessive, unconscionable and unenforceable by a judge.

Depending on your state's laws, the court can find either the entire lease, or just that specific lease clause, to be void and unenforceable if the late charge is unreasonable, excessive and unconscionable as a matter of law.
