Is it legal for our landlord to do this to us?
I live in Arizona. Basically we've been renting month to month a house from our landlord, and recently we found out he hasn't been paying mortgage and we have less then a month to leave. I guess for the last four months he hasn't been paying it and letting the house go under foreclosure. Can he legally take our money like that?

Oh and all those months he didn't pay mortgage we were still giving him money, not knowing he was letting it go.

The problem is where is your deposits and last month's rent if you have paid them??

If it is not foreclosed on yet, then you have a while. If it has gone to court then they should give you a real date to move, and must give you time to find a new place. You still have rights as a resident of that address, even if some say that your lease is void. The new owners will need to evict you too. Don't pay rent any more until you get the real story.

The mortgage is a contract between the landlord and the mortgage holder. Your rental agreement -- whether a lease or other agreement -- is between you and your landlord. One has absolutely nothing to do with the other.

It is legal what he did. Your talking about two different legal contracts. You do have at least two weeks to get out though. If he gets under fire from the mortgage company for not leaving quick enough thats not your problem.

Best thing is to read your contract...

I always rent with a "rental" company usually the ones that sell homes always have a rental departament, they will give you 30 days notice if the house your renting is going on foreclosure.

It all depends on the contract and if it states anything about terminating your lease..

You could sue them if they didn't mention anything about foreclosure or cutting the lease short, just save all your expenses and save every receipt, and call a lawyer.

Ah i just read its month to month, so if he told you 30 days before about the situtation, there is nothing you can do.

This is happening more and more to renters. Be a home owner and pay your own mortgage payment vs. someone else's is the best bet.

Legally, what the landlord does with your rental payments is none of your business. He took your money and provided a roof over your head. It's unfortunate, but all too common these days. Since you are only on a month to month agreement...landlord only needs to give you a months notice to vacate.

I believe legally he has to give you at least a months notice that you have to move out. The only way you'll be able to get money back is to take him to court. Make sure you have all your bank statements that shows that you did pay the man. Good Luck.

Read your contract again, but I don't think he can just tell you to leave in less than a month. If a house is for foreclosure, I don't think you have any other option but leaving, case bank is getting the house.

Actually it is illegal for him to take money from you and not pay his mortgage company. But that is his legal problem.
But your main concern is your security deposit. Stop making your rental payment. You will need to save the money up to move with...Tell the landlord when he pays his mortgage you will pay your rent. In the mean time you are saving up to move with. And when they come to have you move out ask the bank for moving expenses.

sorry to hear that and there is nothing you can do about it.
I would stay (if you like the place) until you have to move. If bank takes it back, most likely you will have to move. But usually it will take some time. It usually takes bank 2 to 3 months to get renters out and put it on the market.
If new owner buys it, it will depend on the new owner.
Legally, if you live there you will have to pay rent. After the day it goes to bank or new owner, stop paying your current landlord.

I dont see the problem, the only way I could see this being something you could run with is if you had a rent to own agreament with your old land lord
