also last year my landlord notified all the tenants in writing telling us that in light of the increase in oil / gas , there have no other alternative but to add an additional energy fee to the rent , the first year it was $30.00 per month in 2007 this year it went up to $50.00 in 2008 , my rent clearly states inclusive of heating , water and all the basics that the land lord is responsible so why am I being charged an aditional energy bill ? Is this legal and if not who can I contact on this matter ?
I live on the Main Line just outside Philly , these apartments are like 90+ years and they have all the original windows which are not double insulated and the landlord is to cheap to upgrade them so I guess the tenants pay for it. Additional Details Additional notes : I am not on a month to month lease , I am on a yearly lease . |

Rent is almost always raised at the end of a lease. And because energy cost are on the rise the landlord can add a utility charge to the new lease. |

of course it's legal - costs go up every year, any landlord would be stupid NOT to raise rents every year. In case you haven't been reading about the increased energy costs - heating oil is already costing 30-50% more than last winter - I have it in my house - ouch! that's a HUGE cost increase - especially if you do not have a lease, you have no defense against it and in many states (like Penna), there is no limit to the size of annual rent increase a landlord can charge - it's whatever the market will bear. Mainline is an expensive area to live in to begin with. lots of cheaper Phila suburbs. |

Rent can be raised, for any reason, at the time of your renewal. Just because you don't pay the energy bill does not mean that the landlord can't raise your rent to defer his costs. |

Yes, unless you have a longer term lease.
I'm not sure about the legality of the energy fees. However my company (a fortune 500) has been passing on similar energy adjustment fees to customers for the last year to kjeep up with the rising costs. Look closely at the electric bill there may be an added fee there.
If its in print you may fight it, but the landlord will just add that cost into base rent if you dont pay electricity separately.
Please dont protest power plant expansions... |

If you don't have a lease, it is legal. EVERYONE is paying energy fees lately. Even with a lease - at renewal time, he has every right to raise your rent. It's your final decision to stay. |

Even if you have a lease their may be a provision for this in the lease. Cost are going up everywhere, just because you rent doesn't make you immune to that.
The state I live in and have rentals in just forced an increase in property tax for my county because they thought our property assessment were too low. My property taxes will go up, I will eat it this year but next year my rents will increase. It is business and in order to stay in business and provide a service you cannot loose money. Like many other people landlords have families they have to provide for.
If you are unhappy move if you can. You wil probably still have to pay for the increased bills where ever you go but you may be able to find a more modern and efficient building. |

Yes, he can legally raise the rent every year and he doesn't need to tell you why. Sometimes it's to your advantage if you plan to rent for many years to have a multi year lease agreement. If you are paying monthly he could even raise it as needed I would think. The down side to raising the rent so often is he may be asking for rent that is above the average income levels for the area and he will be sitting on empty apartments. |

In the UK there is a document/contract called a tenancy agreement. It is the signed by tenant and landlord to confirm how long the tenancy will last (usually 6-12 months) and the amount of rent, they cannot raise the price during this period. If you wish to renew the agreement after the term is up, the landlord is entitled to put the rent at whatever price they want for the new contract, after all you don't have to stay on as the tenant, you can find somewhere else within your price range.
Sometimes areas become more desireable, meaning new tenants would be willing to pay more, sometimes area become less and the opposite happens.
Have you signed any contracts? If not you really have few rights. |
