Hi,
I am a single person with a five bedroom house with a partialy finished basement. I was thinking of completing the basement, putting in a bathroom and kitchen. I would then live there and rent out the upper two floors. Is it ok to do this or do you need permission from the town. I live in West Paterson. I mentioned doing this to my brother-in-law who lives next door and he went nuts, saying it is against the law, this is a single family neighborhood, what's wrong with me! What's wrong with me is having to spend all my money trying to keep a large house. Any feedback would be greatly appreciated! Also why the hostility from the neighbor? |

If you put in a LEGAL basement apartment....that means all renovations are done under permit and inspected....the town will gladly up your taxes to allow you to register your rental unit.
It is a good way to carry the majority of the cost of the house, because you even get to deduct certain things from your taxes (and I suggest you get a professional accountants advice on that).
Being a "family neighbourhood" DOES NOT preclude renters. I assume that since it is a 5 bedroom house, you would be looking to rent it out to a family anyway?!
Ask the town the laws for your area, and if they say it's okay to do this, then go ahead and do it. Your brother-in-law can always move. |

You have to make sure your house lot is zoned for multiple families. Otherwise, your brother in law is correct, it would be illegal for you to rent out part of your property.
If you live in a decent neighborhood the hostility comes from there. Renter bring down the quality of the neighborhood. |

Forget the basement! Rent out 4 of the bedrooms,at 350 a month each,plus a share of utilities. Give your renters full range of the house.Keep a bedroom for yourself.This is a very common practice here in CA,since mortgages are really high.People have to do this just to get by.Only do this if you can stand living with other people.As far as your brother in law is concerned it is none of his bees wax! It is your house,and you are the one that has to pay the mortgage not him.Next time he says something tell him that if he pays your mortgage then he can tell you what to do with your house.Goodluck! |

Two recommendations -
1. Definitely call the local township office and find out if renters are permitted -- not all towns allow this.
2. I assume you have substantial value tied up in your home. Credit and background check the people who will be renting from you and be sure it is in the lease that they have renter's insurance. I would also recommend that you carry an umbrella policy from your insurance agent. This is very cheap protection and covers you over and above your homeowner and auto policy. Good luck. |

Well, I would seek your local laws within your area... I wouldn't see why not it makes sense to me as to why you are doing it...... but the hostility may be that you may not get a great person to rent... So make sure that you get a good written contract to have your up stairs... |

Before you commit to the remodel, check the local zoning codes to ensure you can have a legal duplex on your lot. The city planner's office is a good place to start. Secondly, check your CC&R's, the rules set by your home owner's association if you have one. If you can't find yours, call your HOA or a local Title company. If a duplex is allowable and you have no CC&R against it, I say do it, but be sure you get the necessary permits for your area. This can be a good investment strategy. |
