Today I was helping someone move. It was quite hot in the house, and someone asked the person moving out if they could turn the heater down a bit. She said she couldn't; it was against the rules -- later, she got out a piece of paper discussing the issue.
She's not allowed to change temperature for any reason. That seemed bad enough, but then I found a section that says she's not allowed to open the windows between November and April unless there's a fire or other emergency.
This seemed kind of unfair to me. Someone else there pointed out that it doesn't even sound legal. Is it? Additional Details The copy she had was just a loose sheet with the "rules" printed on it. It wasn't signed by her or anything. I don't know if it was in the agreement.
But my god, it was horribly hot. She has a daughter, too. |

I think it depends on whether or not you pay for utilities. Plus in some places the thermostat controls all the apartments. We don't want to freeze out one person because the others sweat like crazy or visa versa. I think so long as it's kept reasonable there shouldn't be any complaints. |

Contrary to popular belief, just signing a document, or having it part of your lease does not make it legally viable.
When you rent an apartment or house (dwelling) - and keep in mind the laws do vary from state to state - the tenant is paying for the rights to that unit for each month they are paying.
This means they have the right to use the premises to their desire, provided it is not damaging to the unit, or unlawful. Things like painting are not covered, you need permission, unless otherwise stated.
But opening windows, having heat on or off, that is a tenants right to adjust.
Much like a tenant can legally take a landlord to court for not having heat, they can take a landlord to court for not fixing the heat if it's on constantly.
Your friend should contact a tenant attorney for further advice though. |

Yes it is illegal.
Even if this was on lease as a disclaimer...it is illegal to get a tenant to agree to an illegal rule.
I had a landlord one time try to weasel me out of paying with a year's worth of advance rent cheques=also illegal.
The same jerk tried to put this clear plastic box over heat control mechanism for opposite reason--he wanted to squlch on heat...and keep temp at 50 degrees F!~I took knife and cranked heat up...when he complained - I asked for complaint in writing..then took him to court.
Also know landlords may not enter premises without 24 to 48 hrs written notice for emergency...and your subsequent accepting of entry by landlord.(ie: he may not "pop in" unnanounced the day of...)

Tell your friend to make a copy of that paper telling her she may not change temperature and tell her to contact the landlord tenant board in her city and broach the subject--report the landlord.
Your friend should make and save ALL communication between her and landlord in writing...and keep it on file to use in report.
She as tenant must be allowed to have temp at I believe as hot as 72 but surely, there's no rule stating that she may not lower the temperature....If I were her, I'd open the windows...as the other hot air seems to be coming from the landlord.
Believe me-once your landlord realizes you are one tenant who will know and exercise your full rights, he shall exercize extreme caution around you when considering pulling his crap.
Know your rights. From now on...keep everything in writing and make copies. |

The only way this could be legal is if when she was signing her lease it was in the lease or if while she was on the premises during her term there signed a paper regarding it. A verbal agreement would be hard to prove that it was legal other then that. |

That's very strange and I hardly think enforceable. If the thermostat is in her place and she pays the heating bill I hardly think the landlord can enforce it. Ditto on the windows, unless it means leaving them open when she is not home.
Temperature minimums vary by location and can be as low as 55 overnight in some places. |

Yes, that sounds odd. It also seems "unfair." But it could be perfectly legal. If the rules are referenced in the lease, and your friend agreed to the lease, including those additional rules, then very likely they're binding. You or she can check with a real estate lawyer. And she might want to politely let the owner know that the additional heat was probably resulting in additional utility costs. But, bottom line, if she agreed to those rules then, well, she agreed to them. |
