I'M RENTING A HOUSE THAT'S ON THE MARKET FOR SALE. THERE IS A MAINTENANCE AND REPAIR CLAUSE WHICH STATES:
"LESSEE WILL, AT LESSEE'S SOLE EXPENSE, KEEP AND MAINTAIN THE LEASED PREMISES AND APPURTENANCES IN GOOD AND SANITARY CONDITION AND REPAIR DURING THE TERM OF THIS LEASE AND ANY RENEWARL THEREOF... MAJOR MAINTENANCE AND REPAIR OF THE LEASED PREMISES, NOT DUE TO LESSEE'S MISUSE, WASTE OR NEGLECT, SHALL BE THE RESPONSIBILITY OF WHO THE LESSOR OR LESSEE ASSIGNS."
THE LANDSCAPE CONTRACTOR OF THE HOA CUTS THE LAWN, BUT DOESN'T TEND TO ANY WEEDS, WHICH ARE A PROBLEM-- THERE ARE WEEDS EVERYWHERE. I'VE BOUGHT LARGE BOTTLES OF WEED KILLER & SPRAYED, BUT THE WEEDS DON'T APPEAR TO BE GOING ANYWHERE.

According to your lease you are responsible for the weeds. This is standard when leasing a house.
Everyone deals with weeds, this is just part of having a yard. Weeding is just part of the deal. If you do it fairly often you should not have a huge problem. You need to weed more then once a year. |

The weed issue is not your concern. Since the HOA cuts the lawn the entire upkeep of the grass is their concern, and if the landlord wants to deal with weeds he's free to do so on his own. From what quoted, there is nothing that specifically talks about weeds or even the outside of the unit, so forget about it. You are not leasing the lawn, and the "leased premises" covers the inside of the unit only. |

It is YOUR responsiblity. What's the big deal, $20 for some weed and feed. Take proud in where you live.
As a landlord, all my renters are responsible for the first 50 of a repair, unless they caused it (backup toilet, etc).
They are responsible to maintan the lawn and other things.
Just because you rent doesn't mean that you don't have to keep it up. It's the same as with a car lease. |

You're renting a house, which always means the grounds are the tenant's responsibility, and it is spelled out quite clearly in your lease that you (lessee) are required to maintain the premises. You are lucky you don't have to mow the lawn! Kwitcherbitchin & get to work. And if you don't want to do yardwork, next time get an apartment in an apt. complex. |

You asked the same question 10 months ago. Haven't you spoken to the landlord (lessor) about the situation. Tell him that your lease is not clear, and ask what he expects of you. If he wants you to take care of the weeds, he should be buying the chemicals you need. |

The same clause re-written exchanging the terms:

I am not sure of what role the landscape contractor has to do with the house you rent, since generally contractors hired by the HOA do not take care of anything other than common areas of the development. So are you talking about your lawn or something else.
If it is your lawn (that is a part of your rental), you can choose to do the work yourself or simply approach the contractor the next time they are out there and ask how much to take care of your weed issue. |

If he provides landscaping services with the rental (in this case through the HOA) then it is his responsibility. If its in the contract that you are required to maintain the lawn, then its yours. Sounds like its his to me. |
