After I spelled my name (which is African), this lender asks me what my citizen status is. I've never been asked this question before by any lender. He told me because he wanted to know if i was legally, which makes no sense because i wouldn't be looking to buy a house if i was not here legally. Is this normal? I decided not to do business with him but just wanted to know if anyone else has been asked this question before. Additional Details and I am a US citizen. |

yes. this is actually a question on the last page of a uniform residential loan application. they also can ask race/ethnicity. banks typically show this to prove they are compliant with equal opportunity lending laws. if you are still in the market... i would be happy to help. |

Yes, it is legal. And you should not be offended by this question. If you are not a resident of the country you can more easily leave and not pay back your debt.
And people by real estate in countries where they are not residents all the time. |

Yes This question started to rise after 911. It has to do with the patriot act. At the closing they may ask you if you are a terrorist, or plan on harboring one. Are you going to get offended and walk out of the closing? No, so call this guy back and give him the chance to close the loan he worked hard on. |

Yes he can and the main reason being is the scrutiny all mortgage lenders are now under. They were giving out loans like candy to everybody and there mother without checking citizenship status, credit historys, etc... The gov't is now on there **** because of this. Hundreds of homes are now under foreclosure and it's not over yet. They anticipate by years end in the thousands. So I can understand why you are concerned with this question, but this is the reason. yes when i worked for bank of america we asked that question that would tell us if we needed ss or alien numbers it works with credit and helps us determine if you are who you say you are so no one can open up accounts in your name |

Your citizenship status can spell the difference between getting a high APR loan or a low APR loan. There are mortgage lending companies that offer loan programs only to those who have at least permanent residency.
Those only with work visas have more limited options in financing, and may get a higher rate than US citizens and permanent residents. I know of folks who's here on work visa and their permanent residency is still undergoing processing, and they were given a higher rate - and told to refinance their mortgage when they get their permanent residency in order to get a lower rate
Hence when the lender noticed you have an accent and have a foreign sounding name, then they asked your citizenship status.
I have undergone the same process and same questions as you did, given that I am also a immigrant |

The way he asked it may have came off as offensive, but it is perfectly legal...To re-iderate "fatty"'s comment.
On the last page of the 'uniform Residential Loan Application',
Fannie Mae Form 1003 section VIII.
Line J. "Are you a U.S. Citizen"...yes/no
Line K. "are you a permanant resident Alien"...yes/no
So yes it is legal...and normal...etc, etc...

Yes, it's normal to ask whether or you are a citizen. It is a standard question, since a "Non-Resident" Alien can't get all loans available to citizens. A bank doesn't want to lend money to someone who will move out of the country next month. If you are not a citizen of the US, the Loan officer should find out whether you have the legal right to live in the United States, and just as important, whether you have the legal right to be employed in the United States.

It is a legal question and you would be surprised at what the illegals will do. They usually do it with stolen identity though, so asking seems rather futile.
But, on the other hand. DO NOT get a loan via the internet or telephone. You have no idea if the person you are talking to is who and WHERE you think they are. You are running a risk of identity theft yourself. Work with someone in an office, face to face. |
