Tennelle | Is it ok to break my lease if I dont feel safe? |
There is this guy who is stalking me. He keeps knocking on my door and trying to get me to have sex with him for money and trying to sell me drugs. I have no clue who this guy is. I have called the police about it and they have taken police reports but they said there is not a whole lot they can do. I talked to my landlord about it and she told me its not her problem and that I have to deal with it. I dont feel safe there anymore. I want to break my lease so that I dont have to deal with this anymore. Should I break my lease and is there a way to get out of all of the penalties? |

Hell yeah you should break your lease. I'm pretty sure there are legal clauses that you can find to help you get out of breaking your lease. Go to someone who has legal experience and find out what you can do!! Get outta there quick! |

You say you don't know this guy. If you don't know him or talk to him, HOW do you know he wants to have sex with you & sell you drugs?? Do you talk thru the key hole at him? If you don't answer the door, you wouldn't know these things.
The next time he comes to your door, tell him to wait a minute & dial 911. Then the police can talk to him in person. If he is trying to sell you drugs, they can get him for that.
I don't think you are getting the response you want from the landlord or the police for another reason. I don't think they believe you.
The cops need to deal with this guy head on. If that doesn't work, send him down the street to another place & tell him they want sex and drugs down there. |

Safety first! You may lose your deposit and/or you may be sued for the landlord's loss. Read your lease carefully. Why is this guy allowed to roam around the apartment area? Don't you have any security there? Keep filing reports to the police. Put up a security camera and get some proof. What the guy is doing is illegal and he is probably a nut. Call some women's groups to see if they can offer you any help. This guy could eventually hurt you. Be very careful. |

Start with a restraining order against your stalker.
That process will create the foundation for you to get out of your lease lawfully.

Once you sign a written contract, you are subject to follow the guidelines... I would recommend either getting a room mate or renting the place out. |

I would break it anyways, I would not live where I don't feel safe. First ask your lanlord if you can, some of them will let you, offer another months rent first. Good luck and get out. |

Try changing tactics. He is used to intimidating you and you being afraid, so turn the tables on him: the next time he speaks to you, start yelling and screaming in his face.
Redirect his attention to somewhere else, "I hear the man down the street wants sex-- go talk to him."
Ask him for spare change.
Tell him you're a lesbian.
Laugh, as though just the question itself is ridiculous.
Get a restraining order and the moment he violates it, call the po-lice.
(Well, after typing all this, my favorite is still to get in his face and yell and scream at him :-) |

You will need to contact an attorney who deals with landlord /renter issues. I would leave as this guy is potentially dangerous, and deal with the legal issues later. Remember to lock doors/ windows, invest in an alarm system, tell neighbors to be on the look out, and get a restraining order. If he returns at least you have this on paper. If he shows up again, call the police immediately. Good luck and get out of there. Remember always go with your gut feeling. |

Follow your gut and do what is necessary to be safe. Your landlord is right, it's not her problem, although she could be more empathetic to your circumstance. Also, her loss in income from your rental payment is not your problem either, well immediately not your problem.
Worry about the legalities later, and take control of your situation and do what you need to do for your safety.
If possible sub-lease the place, but leave first.
Talk to a lawyer. |
