hi I'm a landlord from GA here is the law regarding my state you should check with your state just google landlord laws in your state but A tenant who occupies rental property with the landlord's consent and makes rent payments without a written lease is called a "tenant-at-will." Georgia landlord-tenant law, including eviction laws and security deposits laws, still applies. A tenant-at-will has the right to occupy and use the rented premises subject to any restrictions upon which the landlord and the tenant have agreed.
Because there is not a written lease, Georgia law regulates the type of notice which a tenant-at-will and the landlord of the tenant-at-will must give to terminate or change the original rental agreement. A tenant must give thirty (30) days notice to the landlord to terminate or change the original agreement. A landlord who has a tenant-at-will must give sixty (60) days notice to the tenant before seeking to terminate the agreement or change any term of the original agreement. This means the landlord must give a tenant-at-will sixty (60) days notice before imposing a rent increase. To protect your legal rights any and all notices should be in writing. When a tenant-at-will fails to pay rent the landlord is not required to give the sixty days notice before terminating the tenancy. If the tenant-at-will fails to pay rent, the landlord can demand possession and immediately file a dispossessory warrant seeking possession in court. |

Depending on your state, even verbal month-to-month tenancies require some sort of lease. Unless you didn't put any deposit down. |

Technically, without a signed lease, and only a verbal agreement, if push came to shove, he would have to prove that you agreed to a specific length of time.
Morally, would you want to screw your LL? The better option would be to explain to your LL what the issue is. He might allow you to bare the burden of finding a new tenant and release you of any obligation you currently have, on paper or other wise.

in my opinion it should be fine. If you haven't signed any paper work stating that you have to live in the apartment for a certain period of time or inform management that you are leaving. Its a little odd that you have not had to sign the paperwork by now. Implications can lead to the apartment filing a bad credit report for you or something of that nature. It would probably be best to bring it up with the landlord once you have found yourself an apartment. Therefore, if there is an argument between you and the landlord and he kicks you out you have a back up place to move into.. this is all just my opinion in the matter. good luck |

Good luck with that. you have to have a very good reason. I was screwed over by an ex roomate that was also a best friend. You have to pay to break a lease and it is not cheap, Right now I am paying monthly payments each month on a 2,400 dollar balance and then I have to sue the roomate to get what he owes to me. |

In most States, you are considered to be living under a month to month agreement, 30 day Notice is required. Use the unsigned Lease as a guideline on how to avoid penalties. Above all else treat the Landlord with respect, surprisingly, most are nice people and as long as you aren't tearing up the property, paying your rent on time, they will often work with "good" tenants should you need to opt out. |
