Is it possible to pass on to your son unpaid home mortgage as inheritance?

Landlord
Yes, upon death the mortgage is assumable. The heirs receive it and do not have to qualify for the loan. The only time that you would is if you need to sell the property or refinance it in order to pay other debts or divide the asset between heirs.

efflandt
Assets of the estate are used to settle debts before estate assets are dispursed. If you inherit a home and not enough other estate assets to pay it off, you need to either refinance it in your name, or sell it and keep whatever (equity) is left after any loans or leins on it are satisfied.

You would not really be inheriting the mortgage, you would be inheriting the equity, and it is up to you to finance the rest if you want to keep it, or sell it for the equity. If there is no equity, or negative equity, you do not inherit the debt (you simply get nothing from it). Although, any debt beyond value could eat up other estate assets.

Jennifer
Hi,
I used "Credit Solution" to settle my mortgage. They managed to reduce my mortgage up to 58%.It's legitimate.I came across this company on NBC News Special Edition.Check it out here:

Can you say "TRUST" ... the title transfers upon your death.

Phoenix
No unless if the deed states its assumable. You may be able to sell the house to your son at a much lesser price or for whatever the balance of your current mortgage but not as inheritance because it hasn't been fully paid yet.

No. Your estate "inherits" any unpaid debt.

If the value of the house exceeds the outstanding balance it is an asset and worth while receiving as an inheritance.

usually. Most banks WANT you to make your mortgage payments. What is a bank going to do with a house? So if you find someone who is willing to pick up your payments, then yes.

rakesh s
Yes Sir ,

As per the inhritance ruling if you passed on any assests to your followers automatically all liabilities thier to will go with assets so dont worry in your case if you transfer property to your son un paid mortgage will also go with it .

Thanking You

Regards

Rakesh

Are you saying that you are receiving payments on a mortgage secured note that you own? If so, then yes. The note is personal property and can be passed on or sold. If you are talking about a home that is encumbered by a mortgage, then also yes. The lenders don't consider that transfer an alienation of title, or a prohibited, callable transfer.
