Is it possible to surrender your property to the mortgage company?
I'm from the UK. I would like to move quickly, but can't sell my house in time. One option is to surrender the property. Is this possible or legal?

Hi,
It is unlikely that your Mortgage lender will want to take voluntary repossession of your property. This normally only follows if arrears have accumulated. Also it would not leave you with a good credit rating with them and these organisations do share information.

From the sound of your question I do not think you would achieve your objective, even if they said YES (which they will not) as moving quickly infers that you wish to get your capital out to move on but once in possession interest will continue to accrue and you will receive no money from the lender until after they have sold your property.

If its speed and the proceeds from your house you are after then try lowering your sale price (if you do have it on the market).

Also speak to your lender they will (hopefully) give you some advise.

They will sell the property for what they can get in a quick auction/sale and you will still be liable for the shortfall if any.

In the U.S. it is possible and legal. This doesn't necessarily mean forclosure. In some cases it can even be a clean wash (so to speak).

Have you considered putting you house up for auction?

Please don't surrender your mortgage just to be able to move quickly - the legal costs will be phenominal. Just contact one of the Sell and buy back companies, but make sure that you choose one that gives you the best price for your house.

it is legal but it does not automatically
absolve you of debt..it simply means
the lender does not have to go to
court to get the property back

[as I have written on this topic,
many times, it is desireable to
install a home based business
to pay for the mortgage!]

Yes. It is called IN LIEU OF FORECLOSURE. There are a few circumstances which need to be present in order to do this. One of them is ..... you can only have 1 mortgage on the property. Call your mortgage company and talk with them about your circumstances. Good Luck!!!!

Hi there
Don't surrender, this will come back to haunt you, your better off listing the property with a Realtor, give them a number were you can be reached or visa verse. The contents can also be listed if you don't want them, and can be used as a bargaining chip in the price.
Your now able to think clearly, and respond to the agent when your up to it.
