Laura in North Carolina | Is it true that many people that are losing their homes never missed a payment? |
|
|

Landlord

It would not be possible. Foreclosure only happen by refusing to make your payments. |
|

chatsplas
 |
NO, not at all
They have missed many payments and been late
Many have not paid in 6 months
It is sad that people are losing their homes, but many didn't have their priorities straight and made many poor choices; others lost jobs and could no longer afford home |
|

No. Not unless they just walk away from it. |

No, if they never missed a payment there would be no cause for a foreclosure. |
|

That is incorrect. With most companies you have to miss 3 consecutative payments before they will start repossession procedures.
Think about it. They have to hire attorneys and such to have this done and it costs them a lot of money. Also, they have to find another person to purchase the house, which will take more time. The mortgage co. would rather have mortgage payments coming in then own a bunch of houses that no one can buy.
I used to work for an attorney and most people have to miss 3 payments in a row to lose a car or house. |

You have to miss payments to be foreclosed. |

Real Estate Guy

YES. Indirectly.
There are many people that are ABLE to make the payments, but because the value is less then they currently own, they are stopping payments and "giving" the house back.
However, this is a DUMB idea. |

If you don't pay your property taxes, the city can put a lien on your property, and yes, eventually you could lose the property, regardless of whether or not you made your mortgage payments. |
|

The only other way they could lose their homes without missing payments if there was some other lien placed on the property. IRS issues (back taxes), the owner was effectively sued and the lien attached to the house to pay the judgment, not paying property taxes, things like that.
Those aren't the types of foreclosures that are being trotted around by the media. |
|

Why would that be? Who is taking the property? Did they refuse to pay their property tax?
If the owner is making the payments, there's no reason for the lender to foreclose unless some other requirement of the mortgage isn't being met. If the owner sold the home, and there's a call clause but they didn't pay off the mortgage, the bank might foreclose. If the owner died and the heirs didn't pay off the mortgage, they lender might foreclose.
But basically, if you're keeping up your end of the deal, the lender will too. |

No. This is not true. You can only be foreclosed on if you no longer make payments on the mortgage. Now, there may be people who are walking away from their homes if they can not pay the higher payment when their mortgage rate adjusts on an adjustable mortgage, or have decided to stop making payments on a house that is worth less than they paid for it, but you cant just have your home taken from you if you never missed a payment (Well - Uncle Sam can if you never pay taxes!) |
