Is it true that you can get evicted if you mess with the smoke alarm in your apartment?
A couple of weeks ago, I was baking chicken, & the alarm went off. My next door neighbors came in & took it off. I asked, "Wouldn't I get evicted for this?" & they said, "No, not @ all! It's not against the law."

But the lease said something about how you can get evicted for tampering with the smoke detector alarm.

I think in most cases you can be evicted for permanently tampering with the smoke alarm. However if your neighbors just took it down until the smoke cleared and then put it back up you should be OK.

Your landlord should take a look at it though - it shouldn't go off that easily.

Yes you can...and in most states it is against the law...not only are you jeopardizing your own safety...but the safety of others in your complex.

All you needed to do was remove the battery until the smoke cleared and then put it back in. Yes you can be evicted for messing with smoke alarms. The landlord is by law required to have them in place. It is the tenant that is to be sure the batteries are always fresh and the alarm is working by preforming the test.

First of all, your neighbors don't live in the home.

Second, you are putting your life at risk every day that you don't have that connected....b/c if a fire is started NEXT door...you'll be dead before you wake up.

Third, you are putting OTHER people's lives at risk because from a fire that may start in your own residence...you are the best defense at stopping the fire first.

Fourth, in my state, in multi-family units built after 1984, smoke alarms are REQUIRED by law and tampering with them is a misdemeanor that carries MANDATORY jail time.

Don't be selfish and irresponsible...fix it.

Call your landlord - which is actually what you should have done in the first place. Explain the situation, and see if the smoke detector can be reinstalled/replaced. Do you really want to live (or die) in an apartment without one?

i don't see why. smoke alarms go off for stupid reasons most of the time....mine goes off whenever i cook (and i DO NOT burn the food!!)

What in the world are your neighbors doing?
They not only put you in harms way but themselves as well.
Did you know disconnecting a smoke alarm is against the Law.
Not just the rental agreement. If you had a real fire and the place burned down to the ground not only would YOU be held liable for it but your neighbors as well.
Let them see this answer. Maybe they will think twice before they tamper with someones safety device.
