Is landlord liable if burgled?
I am in the UK and I am renting a property. Recently the landlord removed the wall and gate which separated the building from another property and has not replaced it. This means the back of the building is now easily accessible to potential intruders. If I were to be burgled, could I realistically make a claim against the landlord for losses incurred? Should I 'threaten' the landlord that I will do this if I am burgled?

Depends if his action is negligent. For example, if the landlord visited your home and left it unlocked and it was burgled then he'd have been negligent and you could have grounds to sue. If the house is securable, and by removing the wall it means it is still securable, then I see no negligence. You need to prove negligence to win a consequential loss claim.

If it affects the terms of your home insurance then maybe it is worth having a go under the concept that the house has changed since you took out the letting agreement - so you'd be asking for a rent reduction on that grounds, but I doubt that your insurance company will be bothered - did they even know the wall existed in the past?

I'd start by asking the landlord nicely what his/her plans are and pointing out your concerns, but threats will get you nowhere.

unless he takes the lock off your door, he's not going to be held liable.

i definitely wouldn't threaten him, i might ask him why he is doing what he's doing, and if there's anyway to get more security or something.

if you would have a burglar break in, it might not hurt to bring the topic up.

It is a reasonable request, but I would say that a gate is a preventative measure at best and will ultimately not prevent you from being burgled. The best solution is 'renter's insurance' which will cover you monetarily if any of your items are stolen.

Depends if its furnished or not and whether the contract specifies anything relating to it.

If it is, then generally the landlord should insure the contents of the property and therefore is liable for claiming in the case of burglary (and this is regardless of any gate or what not being present). If its unfurnished on the other hand and you provide your own content, then the responsibility of getting contents insurance is up to you. Damage to the external parts of the property (windows / doors etc) I would say falls to the landlord.

If the contract explicitly mentions a party who is responsible in this case, which you have signed, this would indicate whether you have to cover cost.

In this particular case, I don't really thing you got a strong case... external materials is for the landlord to manage and replace as he or she pleases.

I'm certainly no legal eagle, but from a common sense perspective, this is what I would see happening.

Seek the advice of a legal party if you're unsure...

Your landlord would only be liable for damage done to the property, it's up to the tenant to cover his own belongings from burglars and accidents within the home. By contents insurance, many companies do tenant insurance specific for your situation. The landlord would only be liable if it was seen as being neglect on his half, taking down a wall sadly doesn't class as neglect as walls and gates are easily gotten passed. It would be neglect if he didn't provide proper fitting locks on windows or doors. It would be like someone claimingagaisnt there landlord if burgulars got in by breaking a single glazed window and saying that its the landlords fault because he didn't provide double glazing, which have been more secure. He doesn't have to provide a wall by law as he would locks. Get tenant contents insurance to cover yourself!

No he's not. You should have your own contents insurance. The landlord will have buildings insurance.

As long as you can still lock your flat up reasonably well then no, I don't think he's liable.

Now if you get mugged inside the building because he left it easy to access... then you have a good case
