Is my ex landlord responsible for replacing the carpets at his expense?
I am getting ready to move out of my current rental. The carpets are falling apart. Everytime i vaccum more of it rips apart. Can they charge me to replace the carpet? i have lived in the house for 5 1/2 years and I believe she replaced the carpet about 2 years before i moved in. The carpet is that cheap rental stuff with no padding underneath and is pieced together in the middle of the room. Kinda like they asked for the cheapest stuff. I just want to make sure they arent going to try to charge me for it. Anyone know if there is a law about it?

The life expectancy of carpet is 10 to 12 yrs. If it is only 7 yrs old and falling apart, then you didnt take very good care of it. I have "cheap" carpet in my own house that is over 15 yrs old because I take care of it. I vaccuum it everyday and have it cleaned once a yr by a professional.
They can replace the carpeting at a prorated cost to you. They take the cost of the carpet & divide it by the yrs you lived there. That could be YOUR cost. So in this case, you could only owe for half the replacement cost.
HOWEVER, As soon as the carpet starting ripping, you had the obligation of notifying the landlord. By not doing so, you caused the damage to be worse. I, as a landlord, would charge you full replacement cost as you neglected to inform me of any problem with the carpet at the first time it happened. And a judge would uphold my decision (I had it happen even with "good" carpeting.) " A tenant is responsible to inform the landlord of any problems or damages, immediately. If not, the cost of the damages is given to the tenant" per a MI judge and my lease.
Is there a law about it? Neglect is up to the judge if its taken to court. Be prepared to show certified mailings, notifying the landlord of the problem, to the judge. If you dont have those, you are going to have a hard time proving it wasnt neglect on your part. Especially if it was new 2 yrs previous to you moving in and was in good shape. The landlord can provide receipt of the carpet showing it was new and the judge will take the typical life span of carpet into consideration, regardless if you think its cheap or expensive carpet.
Yes, you will probably be charged for it.

did you fill out a re-check report when you moved in?
if the carpet was in good condition when you moved in- then yes they will charge you for it. they call it "natural wear and tear". nothing you can do about it. the fact it had no underlay is of no relevance........seek legal advice if can.

It should be considered normal wear and tear for that quality lasting so long. Do you happen to have any pictures from when you first moved in? Do some detective work to c.y.a yourself. When you move out, provide copies of your pictures to the landlord, then he/she will be less likely to go after you. If your landlord is unscrupulous, be prepared to have to fight for your deposit.

I'm not sure if there's a law, but you shouldn't pay for it. I'd mention it to the landlord, say, " I'm getting it all cleaned out but I think you might need to replace the carpet, it's just getting really old" See what they say! If you word it like that, like your saying "YOU might need to" Is much better than saying sorry or "I don't know if I should pay for the carpet?" The 1rst of puts the presure on them and the 2nd says your basically willing to pay for it. The power of psychology..lol!
I think in all reality you should have told them about it falling apart as soon as it started, but not much you can do about that now. Don't worry about it! Oh, and good luck on your move!!!

Your landlord cannot charge you normal wear-and-tear, and I would imagine that a carpet being worn that is over it's warranty period would be considered wear and tear. I would imagine that your landlord, unless they are unreasonable or just ignorant, would not expect you to repay for anything that they knew would only get a few years use anyway. In any case, you have legal recouse, depending on the state you are in, that allows you to go to court at no cost to argue your security deposit charges. Your landlord should refund your deposit, with interest, at the end of your stay.

They can't charge you for what is normal wear and tear. Normal wear and tear is subjective, but they are not entitled to new carpet even if your wear and tear was beyond normal limits.

Probably depends on your agreement when you signed the rental contract? If there was nothing about it in there, just tell her what you told us if she wants you to pay for it.

i don't think they could charge you for that. i think it's should be just normal wear and tear and they can't charge you for that.

If it is falling apart due to normal wear and tear, then you shouldn't have to replace it. All though, I see a peoples court case coming if you do get charged. Take pictures of it before you move out and write in detail what the problems of it so you can prove that was how it was.

no she has the responsibility to replace it that why you give her the deposit money so if any thing get broken or need to replace some that were the money comes in and there no Law and plus she has not replace seen 2 year so it her fault that the carpet it falling apart

I don't know about your rental contract, all my previous rentals had a statement about how general wear and tear could not be blamed/charged upon the tenant. If the carpet just fell apart because of wear and tear/ and it was cheap then i wouldn't pay for it and would argue my point if they tried.

Every sate have their own law about that, but check your contract if there is anything about carpet, usually they write what specific they want you to let you in good shape. They know carpets don't last for ever

You are not responsible for anything that comes under reasonable wear and tear - 7 1/2 years for a cheap carpet is a very long time!

I'm sure you could have demanded they replaced it as soon as it started ripping.
