The landlady is a big animal lover and insisted that we use harm free traps. We tried this and it wasn't working so had a free survey carried out which confirmed there was an infestation and immediate action was required. She was on holiday so we went ahead and paid for the treatment but now she's refusing to reimburse the money. |

If you don't have her okay then no she isn't obligated. You need her approval to spend her money! On the other hand if you were to take it to court (depending on how much it is) and the pest guy actually states "Immediate action was required" meaning this could cause harm to someone then yes she would probably be made to pay this back. NO she is not. You took it upon yourself to incur the cost. The landlord was taking action, however it was not the action you wished. However using harm free traps to treat a home is still treating a home, and fulfiller the obligation of a landlord.
Secondly, you took it upon youself, without the consent of the landlord to treat the rental unit. There was no contract of repayment and therefore, no repayment. |

Yes, I do believe so.
You are renting, so he has ownership of the buildings.
He has to pay for anything that goes wrong with the buildings. (Water lines breaking, Furnace breaking down..etc.)
So as long as you still have your receipts, I think you should be able to get your money back.

Nope, you have to make an agreement before you do it... Your landladys money is her own, you can't spend it when you will!... it'd be like your children using your credit card without permission. |

Where I live our city ordinance states that pest control is the responsibility of the landlord only if it is a multi-unit building like an apartment complex or a duplex. If it is a house, the landlord is not obligated to pay for this service. This being said, I always encourage my customers who are the landlords, that it is to their benefit to pay because pests can damage their property. |

Tuggaman has a point, you never what kind of rulings are going to come out of a small claims court. You actually have the advantage because it only costs a few bucks to file, the 'judges' aren't the most knowledgeable, and the landlord is at a disadvantage in the eyes of most courts. The judges seem to think all landlords are greedy property barons squeezing the life out of helpless tenants in substandard conditions. With the supporting testimony of the pest service, you could sue and win recovery of your costs. Maybe you can avoid this by explaining the situation in clear details to the landlord. It would help to know what sort of infestation we're talking about here. If it's ants, you may have a problem. If it's rats or mice, I think you will win that one. Good luck - try to work it out first. |
