Is my landlord legally permitted to enter my apartment when I am not there?
I sent a note with my rent requesting several repairs to be made. I know they need to give me 24 hours notice before entering. I will not be home all day on Wednesday. I was told by the building manager today that if I want the repair made they will need to enter my apartment even if I am not there. I have 3 appointments that were made months ago and I am very uncomfortable with anyone being there while I am out. I am a very good tenent. Very clean, always pay the rent on time. I have 2 cats though and I am concerned about them getting out and the condition of the apartment when I return. Am I being unreasonable to want to be present while people are working around my stuff? I live in New Hampshire if that matters.

i feel ur pain. landlords can be real jerks about invading your privacy. unfortunately the only thing you can do is try to be there. there should be stricter laws.

it is better to have a run down shack that is paid for in full than to have to live under some landlord's thumb!

save your money and get out as soon as possible!

usually, landlords can enter for the purposes of making necessary repairs. Tell your landlord of your concerns and hopefully they can help make sure there are no problems. Or, have a friend stay there to housesit while you are gone.

They need to give 24 hours notice, but there is no requirement that you be present. If you disallow entry they can charge you either directly or from your deposit for 2 visits, as you wasted their time.

Property owners can enter their property at any time, you can not deny entry. The only stipulation is the notice, but they do not need you to agree to the entry.

Leave a note on the door reminding them of the cats, they are normal people and will respect your cats safety and keep it inside. But you know cats, they could hide and be forgotten until they are zooming to the great outdoors.

Landlords are not required to schedule repairs around your 'at home schedule'. Certainly inform the management about the presence of the cats, and ask them to be aware so that they do not escape. Perhaps you could keep the cats in a room which will not be entered during the repairs ?

Yes. It is in your leasing agreement that a landlord or landlord's agent (repairman, property manager) may enter the property to make repairs with notice to tenant. Don't worry about it-no one's going to steal anything.

Ideally it would be great if you could be home but you also have to understand maybe there repair guy is only on the property during the hours or 9-5 or maybe only on certain days. You can't expect someoen to stay late or invonvenience themselves for soemthign you need repaired. Think of the cable guy, they tell you to be home during certain hours, maybe you could schedule a time and go home on your lunch hour or take a few hours off work.

I am pretty sure in any state it is legal for them to be there when you are not, but either way they must give a 24 hour notice.

Yes. The landlord can enter the apt. for needed repairs after posting a 24 hour notice to enter. If you don't want someone in your apt. unattended, then you need to cancel your appointments and be there, or ask the landlord to reschedule at another time. (This may not be possible, or a service charge may be charged to reschedule the appointment, so be aware of this)
If you feel comfortable with your manager, or assistant manager, ask if it is possible if they stay in the apartment while the worker is there.
If all else fails and you can't be there, then make a BIG sign and put in on the front door about the cats, so that they are aware of the kitties and make sure that they are mind full that they don't get out.

Hi,
It would be great if you could be there, but the law does not require that the renter be there when the Landlord or maintenance people enter the unit as long as proper notice has been given.


Trouble
You requested the repairs be made and the landlord has a legal obligation to make the repairs.

There is no law requiring that you be home in order for the landlord or his repair person to enter, only that you be given reasonable notice.

You should consider either having a friend or family member be present or keeping your cats confined while the repairs are being done.

It is unreasonabe to expect the landlord to schedule repairs around your schedule and your preference to be present.

You have a right to be there, but they also have a right to put off your repair since the date they wanted to come wasn't acceptable to you.

You're obligated to request entrance when you're there and then only, if you don't want them to enter, they can't.
