I have recently moved into a new house and the landlord is already behaving strangely. She turned up here unannounced on a saturday night and tried to push her way in. She says we have three sets of keys to the building (we don't) and she wants one set back. I'm worried that she is going to come here when we're not home and come in. She will have a set of keys to the property. You only have to give her a set of keys if you have had an extra set cut without permission. If you just have they keys given to you by her when you signed the contract you have nothing to worry about.
Landlords can not enter the property without giving you 24 hrs notice (unless it is an emergency) - but they can enter without you being there after that notice period. By being a tenant you have the right to exclusive use of the property and that means she can not let herself in without giving you the notice.
I would keep a log of when she turns up without notice as you may want to refer to it later. If she tries to force her way into the property again I would remind her that she has no right and that you will call the police but hopefully it won't come to that.

This is her house, you have no rights to deny her entry.
She has to give you 24 hours notice only. You do not have to be home when she enters HER property, but you do have to be given notice.
She can enter without notice in a crisis situation. |

Yes she has a right to have the keys for emergencies, but she can only enter with notice (notice varies by location, where I live it's 48 hrs in writing). If she wants to change the locks in order to control how many keys are out, she should do that at her expense. If she barges her way in you should call the police.
You pay for the right to the space. If she wants access to the home, she should not lease it out, then she will have all the access she wants. She made a legal contract stating that it is yours to use. That's why I would never rent from individuals -- they can be so unprofessional. |

It's her property and she has a right to have a set of keys. She has a right to make inspections or repairs, but not unannounced. You don't want anyone to have a set of keys to your home, then you need to buy your own place. READ your lease. |

In California, she is entitled to have a set of keys to all locks of the house. However, she must give you 24 hours notice before entering the house unless it is an emergency (plumbing issue, fire, police situation, etc.) or if you gave her permission. She can't abuse this 24 hour rule either. I think once a month is fine, 2 times a month maybe borderline and every week, you might have a case to break your lease without any issues. |

Yes you have to, though she MUST give proper notice of entry and it must be for a specific purpose.
Look at your lease and cite the proper clause. "Sufficient notice" is usually considered to be a full day's notice, except in some emergency. Here is the clause in the lease provided by my city's Housing Department:
"LESSOR reserves the right in accordance herewith to enter the Apartment in order to inspect same, make necessary or agreed repairs, decoration, alterations, or improvements, supply necessary or agreed services, or exhibit the Apartment to prospective or actual purchasers, mortgagees, tenants, workmen or contractors, or as is otherwise necessary in the operation and/or protection of the building, its components or persons therein. At LESSOR's discretion, LESSOR may retain and use copies of any keys necessary. for access to the Apartment within the last 30 days of this LEASE, after default of LEASE by LESSEE or within the 30 days of LESSEE's notified intent to vacate. LESSOR retains the right to show the Apartment for rent with sufficient notice. LESSEE specifically consents that LESSOR may enter the Apartment for the above purposes at times when LESSEE is not present. "

I only know landlord/tenant laws in state of Oregon, and, I'm a landlord by agent. However, I cannot imagine they are too much different in any other state.
Please, keep in mind, though, this answer is based on Oregon laws.
Being you are leasing/renting, your landlord must have a set of keys in the event of an emergency or inconvenience to you (you locked your keys inside).
However, in Oregon, a landlord cannot enter a rental property without permission of the lessor/renter.
It sounds as though she was sleeping and neglectful when she rented/leased the place to you and now she's trying to cover her toukas. And, she doesn't sound as though she's a landlord who can be trusted.
Change the locks, give her one set, you keep the other. As you give her set of keys, inform her she must issue a 24-hour notice (which actually takes 3 days here beginning to end) and she must state the reason for her entry in the notice.
This will be tedious on your part, but, go online, check out landlord/tenant laws for your state (some of these can be so mystically arcane). Print them out. Read them over. You really cannot trust anyone anymore, you have to take it upon yourself to be properly informed. In other words? You have do your landlord's job for him/her.
If this chick is violating landlord/tenant law in your state, contact your state's attorney-general, better business bureau, sue her toukas off.
If it turns out you do not have the option to sue, then, plaster her name all over the Internet!

She has the right to have keys to the flat as she owns the property, but if you don't have the stated amount of keys its not your responsibility to provide them. I would hope that there was an inventory and check in done at the start of your tenancy, the number of key sets handed over would be stated here. You can return a set of keys and it might help the relationship and build a little trust to borrow a set back for her to make a copy. But keys are the landlord's responsibility until you lose them.
Your landlord should not be turning up to the property unannounced, I hope you have a tenancy agreement, of which there will be the clause about 'quiet enjoyment' which you are entitled to. As part of this the landlord has to give you at least 24hrs notice. |

Hello there!
If it was done thru an agent, they may have retained one or two sets!
Typically the landlord will have a set of keys anyway, and they can gain entry to the house under one of three conditions.
1 - There is an emergency in the building
2 - With your permission
3 - As a pre arranged time with yourself.
HOWEVER!! Check your contract as there are often additional clauses!!
If you have an inventory, make sure how many keys are listed!! If it claims you have three, then you have to give three back at the end too!!
