I signed a 1300 p/month lease for a town house that had a washer/dryer/dishwasher stove and fridge. i was told they were all in working order. Upon moving in I learned only the fridge works. I understand maybe the dishwasher not being a neccesity but the stove? and was told unit came with w/d. It has now been a month since ive been asking for a replacement and landlord said she would, still nothing. NOW shes saying she isnt required to give me a washer or dryer, but she will supply a washer and i can hang my clothes???? But i havent even gotten that much. I NEED a stove. Can i withhold rent and tell her i will pay in full when she lives up to her obligations??? Take out food and laundromats are getting costly. I have a child to feed and clothe. Side note, there isnt a Certificate of Occupnacy yet either, would they require her to comply? |

You are legally entitled to 1 working burner on a stove, in every state.
The rest of the appliances depend on what your lease states. If the lease states that you have the others, and they are not listed as "personal property" of the landlord, you are entitled to them as well. If they are not mentioned, they are not required. If they are listed as "personal property" they are legally being borrowed from the landlord, which means YOU fix them or do without. Dishwashers are generally NOT personal as they are usually built in.
In most states you have to set up an escrow account (you do this through the courts) if you are planning to withhold rent based on things you are legally entitled to. |

I would suggest contacting your housing authority in your area before you start withholding rent. There is typically a procedure for that and since I have no idea where you live, it may be different for you. |

If you are sure a CO is required and the landlord has failed to obtain one, you are in the drivers seat, contact the local zoning had watch the fun begin, beware though you may have to move under that fact pattern but it could cost the landlord monies in paying for your move |

Check your lease to see whose responsibility the major appliances are, and what appliances are guaranteed to come with the unit. That will give you a lot of ammunition. Also, the verbal agreement that the appliances were present and working and your visual inspection that the appliances were present, creates an implication that you were renting a place that had such appliances, and therefore you could sue for misrepresentation of the amenities and appliances. DO NOT simply withhold rent, she will then evict you. Check your lease then contact an attorney. |

Read your lease very carefully. Appliances are not required by law. Some leases say that appliances are provided for the convenience of the renter, but are not included in the rent. This means, if they work you can use them and if they don't you can get your own. I repair mine as a courtesy to my renters but be assured they are cheap bare-bones low-end appliances.
Who is required to get the CO? You or the landlord?
The only thing a landlord MUST supply are working hook-ups to gas, power and phone. |

Check the lease, whatever appliances are specified in the lease as being supplied by the landlord must be supplied by the landlord.
For instance, all my units I supply a stove and refrigerator in a few units there is a washer or washer & dryer. Those are not listed on the lease and the tenant is verbally told that those are supplied as a convenience and that I will not replace or repair if they stop working. When one of those stop working, unless the tenant has it repaired, it is removed and disposed of. |

Check your lease and see what it says. If its a new complex, check the "public offering statement."
Whatever is on there, they have to supply, if they don't, get a lawyer and tell them you want to get out of the lease if they don't install new appliances. |

You need to check over the particulars of the lease agreement, I'm hoping you do have one ? You should, or else your landlord can take you for a ride.
If the house was rented out as fully furnished with stove/fridge then you do have rights.
Normally the landlord/landlady is responsible for maintenance of the building itself and all fixtures and fittings, unless your lease says otherwise. You could well be within your rights to withhold rent but be very careful before you do. Give plenty notice of taking that action first before actually carrying it out. Also, make sure you are the legitimate leaseholder, with both hers and your signatures on the document before you take any action, otherwise she could have you thrown out and there's not much you can do about it.
I'm not sure about the US but here in the UK we have a citizens rights bureau that can give free legal advice to people in situations similar to yours. Maybe try to find out of you have something like that where you are. |

I'd start looking! if she will not comply tell her since she is not living up to her agreement that your attorney will be in contact, BREECH OF TRUST. the law is on your side, you have rights as does she but if you pay she has to provide what she agreed to in contract. Contractually obligated to! |
