So It's already may and my landlord got confused by an early rent payment that i sent out this month and desided to go back and try to recall all the rent payments I've made thus far. So he called me back saying his bank has no record of December's rent. Since I pay my rent by money order, I have no records of it either. My opinion on this is that if they were missing a payment I should have been notified a lot earlier. I don't feel by law that I would be held responsiple be these sercomstances. On the other hand I don't know by law if it would be up to me to prove that I did make it. Anyone have any insight into this situation or know where to find more info? Additional Details The really irronic part to this whole thing is that I keep all my recipts and then occationally clear them out when they start to overfill my junk drawer. I just tossed them all last week. And since March I've been using chckings. So no I am not just a really big rearted unresponsible idiot. I'm just a little unfortunate that they can't get there crap together. By the way I do think im being scammed. If I were to guess I would say that they recieved that money order and misplaced it never cashed it and are now just realizing it and are comming back at me for it. The fact remains that they should have caught it earlier and I would have been able to some up with the recipt and had a new one isued. Grrr! I'm really agitated! |

If you pay by Money Order then you are given a receipt for it. On Judge Judy ( ha ha), she always mentions if you pay by cash get a receipt......if you pay by money order then a receipt is given to you and to keep that on file.
I am sorry you are having to go through this so many months past. But please try to keep receipts.......if you hand the money order to the land lord then get a receipt from them.
If it is the same place that you get the money order from....ask them if there is any way they can look up what money orders....dates....and amounts that you have purchased. |

Go to the place where you got the money order and see if they have record of it. At least you have something showing the amount.
You may even be able to have them track if it was cashed and by whom. There is always a money trail. |

If you paid by Money Order you certainly should have a receipt of the Money Order. If the Money Order was cashed in the record will reveal who did the cashing. If you do not have a receipt of the money order you will probably have to pay for the mistake of not retaining the receipt. |

You should have been notified a lot earlier, and that may help you some what, however If you don't have anything to show you paid there is a good chance a court would make you pay it again. You could call a lawyer and simply ask. If you have a scanner for your computer I would scan a copy of your money order each time just so you can keep it on record if anything else ever comes up so you don't get burned again. |

That is what the tab on the money order is for, to prove if the money order has been cashed. If he didn't give you a receipt for your payments, you may be in a bit of trouble. Try to find those receipts. |

when it comes to paying rent or any bill for that matter...you ALWAYS ALWAYS ALWAYS need to keep a record of it. THat way if things like this DO happen, then you can prove it. i don;t know that you will be able to get out of paying unless you can talk your landlord into believing you. good luck, and from here on out.....KEEP RECORD OF EVERYTHING!!!!!!!!! |

Legally you need to show proof that you paid the rent for that month. If you were brought to court, the landlord has proof you didn't pay the rent, because he doesn't have a record of you paying. Usually landlords keep great records. There livelihood is on the line. and you have no records because you pay with money orders. You'll definitely lose this battle. My advice is to learn from this. Pay the rent for December. You should then open a checking account, so you have bank records of everything you pay. or you can photocopy your money orders before you give them to your landlord. But you should really open a checking account.

If you pay by money order they always come with a reciept. You have to fill in who you are paying the money to, but theamount for the date you say should be sufficient proof that you made the effort. Also if you keep your reciept you can contact the issuer for a picture of the cancelled money order.
If you tossed your reciept and they have no record, the judgement will probably go against you if they have no previous record of trying the screw their tenents out of rent payments
If he is senile; he will screw up again, so rather than lose your cool, keep it and what goes around will probably come around and you will still be in the place you wanted in the first place. |

Your kind of between a rock and a hard place. Technically you shouldn't have to pay but you'll never be able to prove it. Best thing to do is get a checking account so you can track this thing next time. |

There is a technicality in our landlord/tenant laws(California) that says roughly "if a landlord accepts January's rent then December's rent is presumed to have been paid". You should be OK if he tries to force you to pay rent that is 5 months overdue because I believe it is his responsibility to prove you did not pay the rent and I don't think he can do that. |
