Is the landlord responsible for bringing our wood stove up to code?
We asked our land lord to have our chimney swept and when they came out to do it they said it was not up to code and he refused to sweep it. We rely on our stove for heat in the winter, as a much cheaper source! The only other heaters in the house are electrical and they smell funny and cost a ton to run. Is the landlord responsible for bringing the stove up to code so that we may use it?

If the wood stove is listed on your lease, yes, he is. But it is an appliance, like a microwave where he has no legal obligation to keep functioning if he does not want to.

He HAS to provide a heat source, but it sounds like he has that covered.

If I were renting a house, I would remove any wood stove so that it would (a) not be a fire hazard when a tenant uses it improperly, and (b) not violate code. Upon hearing that the stove is not "to code", your LL may simply remove it or give you written notice not to use it again.

If you really want the stove to work, I would suggest doing some research to find out what needs to be done to it, then work with the landlord to have it done for your mutual benefit. Maybe have a stove guy give you a quote.

I would ask the power company to come and clean the electrical heaters if they are installed in the house. It's incredibly dangerous to rely on your stove. If the fireplace is the only heat available in the house and was when you started renting then he is obligated to fix it or replace it with a viable replacement.

Yes anything that needs to be fixed on the property is the landlord's responsibility. The only exception would be if you caused the problem then of course morally you would be responsible for it but your not always obligated and its subject to the terms of your lease.

Yes they are required to bring it up to code since they rented you the place and you have had use of it in the past.

The landlord is responsible for the structure of the building. If the stove is the property of the landlord then the landlord is responsible for the condition of the stove, so you should call the local building inspector. Even if the lease or rental agreement says that you are responsible for the cost of wood to use in the stove, if the stove is defective then that is the landlord's responsibility. If the stove belongs to you then it is your own problem.

If there is electrical heat - then they are not legally required to fix the wood stove. They are legally required to provide heat, but the laws do not state what kind of heat or at what cost.

Deffinitely yes if you call an inspector the my write a ticket though,
in your rental agreement does it state the landlord is suppose to do
this?

Some homes do not have central, and maybe you can get cheaper rent by simply telling him you could replaced the stove.

Does it work?
Does the city allow it?
The inspector may write tickets until it is up to code,
tell you landlord first about it.
Ask him if he can replace it.
How do you know it is not up to code?
did you recieve a ticket from code enforcement.

Is it a woodstove to heat the home than the landlord is responsible but if it is only a woodstove for cooking no he is not, depending on the city code, or county codes and if the county does not have a code, only if you live withing city limits
