Is the landlord responsible if you have a electrical fire and you have no rental insurance in Illinois?

Angie
If for some reason the fire was caused by wiring that wasn't up to code, they do have a responsibility. To be sure, you should contact your local chapter of Tenants Rights and check. Here some info:

ITU provides the following services: (1) lease-breaking before end of term; (2) pressuring landlords for repairs with inspections and rent withholding; (3) getting legal representation for tenants being sued for eviction; and (4) assisting tenants in getting refunds of their security deposits. ITU is not a legal services corporation, but its Executive Director is an attorney and they can recommend tenant attorneys.

Most landlords' insurance only covers damage to the building itself and not the contents of the building. This is why you are urged to get renter's insurance. Ask the landlord to check his policy (though I doubt it will contain coverage for you).

If the landlord had some liability (improper wiring, etc) you could make a claim against the liability portion of his insurance, but otherwise, no. Tenants are responsible for obtaining their own insurance.

Who's fault was the fire? If the wiring in your home was faulty, it should be the landlord's problem. If you overloaded an outlet, or had a device plugged in which was faulty, it would be your fault. Renter's laws may vary, I'm giving you a firefighter's perspective. You should be able to get a report from your local fore marshall's office which will specify the cause.

If it's the landlord's fault, you should be able to sue, even if Illinois renter's law doesn't make it explicitly his/her fault.

acermill
Depends on the nature of said fire. If the cause was not improper wiring in the unit, and was caused by one of YOUR items, YOU are responsible for damages. The landlord's insurer will cover the costs of the repairs for the landlord, and will then sue YOU to recover damages.

NOW you know why renter's insurance is highly recommended. It will cover YOU from such a loss if you are found to be at fault for such a fire.

If you are found at fault, be prepared for a very expensive lesson in insuring yourself.

No. Not unless you can prove negligence on his part. This is why God created Renters' Insurance.

infinite crisis 247
no. the landlord's insurance only covers the physical structure of the premises. it does not cover your belongings. the only way that i could possibly see you getting anything for your stuff is if you could somehow prove that negligence caused the fire. good luck on that one. chalk this one up to a "lesson learned".

PlNk pEaRlS
... that's why you should get renters insurance. And it really depends. Was it due to faulty wiring? Or did you have too many things plugged into one socket or spill water or something electrical. Whose fault was it? That is who is responsible for the damages to the building. Anything that you lost in the fire is your own problem to deal with. Renters insurance would have covered it!

Expert Realtor
Depends on what caused the electrical fire.

If it was cause by a faulty applicance or that you overloaded a circuit, then it's your responsibility.

It it happened spontaneously (rare), within the walls, or to an appliance that the landlord has, then it's his.

Sweetharttt
No. His insurance covers the building. Renter's insurance covers the contents that to not belong to the landlord.

boilerette72
generally your landlord is only responsible for your personal items if he was negligent. otherwise, your renters insurance should cover your stuff.

Ross
The landlord should have insurance. He doesn't insure your things but should have liability insurance. If he is liable than he should pay, if not than you are on your own.

All my leases state my tenants needs to carry their own insurance. It will still come down to the results of the investigation to determine who is at fault.
