no you can't force them to cash it within a month but you can send a money order...that way the money is already out of your account and there is no possibility of a check hitting at a bad time. They are usually very cheap. |

No, he can cash it when he wants.
I had a landlord do the samething and I ended up switching to money orders, that way it is out the day i purchase it, and i can keep the stub as a receipt-- and proof of the day I paid him. |

I'd go with a bank check (usually a $1 fee) where the bank takes the money directly out of your account so you won't have to wait for it to clear. And they are usually void after 60 days, so you'd get the money back if he doesn't cash it within that time frame. Ask your bank about their time frames for bankers checks and the fees associated with it. |

Probably not within a month, but most banks have a 90 day time limit on cashing checks. Although that completely depends upon if the teller cashing it looks at the date on the check. My bank put one through that was over 90 days and they were obligated to refund the money to my account - I didn't make them do it because the check had been made out to a fund-raising organization - but technically, I could have made them do it because they cashed it beyond the 90 day limit. |

Instead of paying by personal check, send a money order (You can get at Walmart for less than a dollar) OR get a bank check from your bank.
These are certified funds and will be taken from your account right away- this way who cares when he actually get's the cash from them AND it won't affect your checking account by bouncing a check or anything.
Make sure you keep your carbon copy and get a receipt from the landlord if you can because you won't get a cancelled check back later. |

Unfortunately, checks come with a 'validity life' of between 60 & 90 days and the recipient can cash it at any time.
**I'd go with the first suggestion of a money order.

A check is stale dated after 6 months. So he can cash it up to that time. I don't understand what the problem is with him holding it for a while. Shouldn't affect you one way or the other. Actually if you have an interest bearing checking account it is to your advantage because you would still be earning interest on it till he cashed it. |

Banks usually honor checks for 90 days or 6 months. Check with your financial institution. The payee then has this amount of time to present the check. Not much you can do about it.
But since your landlord is not cashing your checks right away, I would insist on a receipt when you give him them your check. This will ensure that in the event something happens, your landlord can't come back and say you didn't pay your rent. |

You ask your bank to print on your checks something like " Not valid after 60 days"...in the meantime, you can write it yourself, but no, no legal recourse. |

You can't EVER force them to cash the check. |
