You file for an eviction with the superior court.

Since you do not know how I would suggest that you use an eviction service, it costs 600, flat fee and they will handle everything.

Give them a written eviction notice stating that you would like them out of the house in 30 days. If they don't comply with that, you can take them to court over the matter. However, if they signed a lease, make sure you follow the lease when evicting them, or they could counter-sue.

Further to what Pamela said, there is an act (a law) that governs landlor & tenant relationships. Educate yourself on the various responsibilities of each party to see where your situation lies. There are rules on BOTH sides. Long and short of this is that a proper eviction does take time and quite often when the tenant pays the rent 'at the last minute', the law is on their side.

You have to take them to housing court. And, to be honest, it will most likely take 6 months. During that time, they will not pay rent. I speak from experience, as a landlord. Good luck though. Make sure that you handled their deposit correctly. If you didn't, then they will have the freerent AND, you'll be writing them a check. Sorry...

Have you issued them an eviction notice yet? Typically you have to give them 30 days notice, but if they are in violation of the written contract you have with them, then perhaps it could be accelerated. If you are concerned with damages they might do as a result of an eviction notice, then go in and take pictures of the place detailing how it looks now, and do it again after they have left. When you take tehm to court with all the paperwork you have as the landlord, and the receipts with all the gaps, the pictures if there is any damage would be the final straw. The first thing I would do is find a lawyer, and start working a small claims case against them now so you know where to find them and they can be served notice to appear in court. After they leave it is anybodys guess where they will be. Hope this helps.

I'm not sure where you are from, but tenant and landlord issues are usually governed by the provincial government. This is the Ontario Landlord Tenant Board... I'm sure each province (or state) would have something equivalent linked off of their provincial website. It has helpful advice for landlords as well as steps to take if a dispute (such as not paying rent) cannot be resolved.

Go down to the court house. Depending on where you live, you may have several options for eviction notices. When I was living in West Michigan, I was told that could get a 30 day notice or a expedited notice, which gave them a week.

You have to go through the process of eviction... which is long... You will probably want to check local laws etc.. once you go through the process, the last step is the sheriff coming out with you to basically kick them to the curb...

If they still do not pay you can go to court and file eviction, but the court will require that you do the 30 day notice first and they will not allow you to file till the 30 day notice expires.

If they still will not leave after court- then the sheriff will remove them from the property.

Contact a lawyer or legal office, file for eviction, the office will deliver the eviction papers, and if in 30 days they haven't complied, authorities will force them out.

Ist give them a 30 day notice stating they have 30 days to pay the rent or leave the premises. Then get a lawyer and bring them to court to either pay up what they owe or you simply want them to vacate the premises. Have a process server hand them the court date which the lawyer sets up. Hopefully they don't show and you will get the eviction automatically.
Them get on the list for the sheriff to post a 3 day notice on the door telling the tenants they have 3 days to vacate. That should send the message. If they don't leave when the sheriff comes back in 3 days, there stuff should end up on the street and you will have to pay to have it removed from your house to the sheriff. I did it and it worked. This is a New York ,LI procedure. Check with your county. Good luck

I they have not paid rent, you will likely have to serve them a proper Notice to Pay or Quit, depending on your state's landlord tenant laws, it could be anywhere from 3-15 days.

If they do not pay or vacate, then you start the eviction process.

You should probably call and make an appointment to consult with an attorney and have him handle the case.
