Is this a breach of contract?
We rented a house to a couple who wanted to buy it but needed a little time to get financing in order. we agreed to a contract for deed or lease with option. Well, now they are divorcing and we are wondering since we leased with this intention to "sell" our house to them and both their names are on the contract, is this a breach because he's wanting off the contract/lease?

I have never heard of a "lease to buy" contract EVER finishing, and I am not a youngster.

You are related what happens 100% of the time,(that I have seen or heard anyway), the buyer can not perform. What happens is always the same, you keep your house and any monies that have been involved. The renter is really just a renter and moves on with life.

You will not be able to sue for additional funds, as legally they are just renters. They can not sue for any refunds, as they did not fulfill the terms of their contract.

Lease / Rental Contracts with a buy option are nothing more than Lease / Rental Contracts until the Leaser exercises his buy option and sets up an escrow.

In simple terms, you have a Rental Contract and Renters, nothing more. Treat them the same as you would any other Renters getting a divorce.

Owned Rentals for 32 yrs.


Rush is a band
Certainly when they signed they intended to buy the house. Now their circumstances have changed and you probably have the right to keep some excess money in case they don't buy.

I agree with alterfemego that you should probably agree to terminate the lease. You shouldn't renew it at all and then you should sell the place as you originally intended.

It is a breach on their part. If you had them pay any down payment/earnest money etc. there should be something on your contract stating you get to keep that. If they couldn't qualify when they first moved in it's even more doubtful that which ever one wants to stay would qualify on their own. I would tell them you consider the contract broken. It really depends on what the terms of the contract are. What you intended to do is not relevant if it is not specified in the lease. If he is not living up to the terms of the contract he is in breach. If the contract gives him an out, he is not in breach regardless of anything else that was discussed, etc, outside of the specific terms of the contract.

You will never see anything out of this, move on. They have more problems than a house contract.

I'd retain any non-refundable deposits & send them both on their merry way. Contract over, can't be executed, chances are ex-fiance can't qualify or make the payments on her own.

Start the notice to vacate as soon as your contract allows.

There will be 10 more begging to replace them.

You're better off letting them both leave, the sooner the better. No sense in getting involved with a divorce.

While seller financining is pretty attractive theses days, is it really in your best interests in the long run? Especially if this kind of thing happens. You might consider just selling it outright and be done with it.
