Eclipse | Is this a legal eviction in NYC when a landlord gives 7 day notice but no valid reason? |
I rent a room in a brownstone in NYC on a week to week basis. Any time in the past that I've asked the landlord to fix something, he always says that he doesn't have the money to make any repairs. I constantly make his aware that these repairs need to be made if I'm paying rent. The landlord told me that it wasn't my business what happened to the money that I gave him after it was given to him regardless of repairs needed to the place.
One night I return home and I see what looks like a eviction notice that was dated the 17th and the date was the 20th giving me a 7 day notice to vacant the premises. The date on the notice says I have to be out by the 22nd. Honestly the letter looks like it may not be valid, Like it was typed on a typewriter. When I called to speak with him the only reason that he gave me was that he was uncomfortable and that he wanted the place back and he basically doesn't like me and to just contact his attorney.
Is this grounds to legally evict me? What should I do? Should I fight it? |

He is not evicting you, he is simply choosing to terminate your week to week lease by giving you a weeks notice.

its a week to week lease?? so basically telling you at the end of your lease, he's not renting out the apartment anymore... although you need more time, since it is a week by week lease, its perfectly legal |

NYS and City law requires the landlord to give you a notice period equal to a pay period. If you pay monthly, you get 30 days. If you pay weekly, 7 days. He is NOT evicting you....he is simply terminating your tenancy. Notice can be written in crayon on a dirty napkin...it doesn't matter how...has long as you receive it. |

You are an at will tenant so he does not have to give you a reason.
The length of notice is the same as the lease term - so on a week to week 7 days notice is legal. However he did not give you full 7 days notice if it was not posted before today. The date on the paper is immaterial if he did not give it to you then. I would say you have till the 27th to be out. He would have to go to court to fight you on that and that will take longer than the couple extra days anyway.
A notice does not have to be on any form to be valid. Just something typed up like that is legal. |

A seven day notice can only be used for non-payment of rent. But your landlord doesn't need any reason to evict you as long as you are given 30 days written notice. I am a landlord |
