Is this covered by my security deposit ?
Im moving out of my apartment and i wanted to know what will happen if i take the refrigerator.Im pretty sure my security deposit will cover it but i don't want the police called on me. Some one told me they could take me to small claims court and sue me also.Could you please give me some insight on what would happen. Oh and i live in california if that makes a difference. Your security deposit is to cover damages you may have made in the apartment, not theft of a refrigerator. Small claims court no, you will be arrested for theft, fined, thrown in jail and then made to pay for it, then suddenly your security deposit does not cover the damages and costs of cleaning etc for your apartment.

It is theft.

You'll get an old refrigerator and they will take money out of your deposit to buy a new one. If there is not enough money, they will sue you. They can also charge you for the delivery, etc of the new fridge.

Why would you do this?

That is called theft. It is not covered by your security deposit.

Did it ever occur to you to just get your deposit back and then buy a new refrigerator?

You will not have your security deposit returned (which i can't imagine is less than the cost of the fridge). In addition, they can call the cops on you, and it can possibly affect your credit.

How much is a refrigerator? Why don't you just get your security deposit back and buy a fridge?

It is theft and absolutely they can call the police on you and you will have both criminal charges and civil charges brought against you.

If I was the landlord I would call the police. It's simple theft, not a civil matter.

If you left it full of rotten food and filthy you would only get sued. Take it and get arrested for sure.

No.. not small claims court.. they'll send your butt to jail. That is theft! And if it is worth $500 or more you could serve time on it. I am a landlord and I have to tell you that I pursue it when anybody takes or breaks my appliances willfully. Most definitely this is NOT covered on your security deposit. I would, and have, called the police on people who have taken things from my houses. It is theft, plain and simple.

It is theft.
The security deposit is used to offset the costs of cleaning if you left a mess or repairs for any damages.
You are responsible if the deposit does not cover the costs.
Before moving out,make sure any damages are repaired and the place is clean.
Have the landlord/manager do a walk through inspection with you and take pictures of every room before you actually leave and keep records of when you moved in and actually moved out,even if it was early.

Yes, definitely theft and not worth you getting a permanent record if the owner prosecutes. As an ex-landlord, I would have pursued anyone who took an appliance or willfully destroyed property.

Besides doing stuff like this is just in bad taste. Would you want someone doing that to you?
