Is this illegal for landlords to do or perfectly ok?
So I've been hunting for a somewhere (non apartment) to rent since March and so far have been unsuccessful for various reasons. Yesterday was a first for me though. So a 3 bedroom house was for rent in a very convenient location for my boyfriend and me, and in the price range we were looking for. This was about a month ago, I called for details and because of a situation we were in, my boyfriend didn't want to rent anything at the time. A few days after I talked to the woman, the house was rented. So right now we're scrambling trying to find a place and that became available again, a month after it got rented. I finally got ahold of the woman again and she told me that she doesn't rent to unmarried couples, that they've had problems before with them. I think that's why it was back up a month after it was rented. But is that even legal for her to do? I couldn't really do anything about it anyway, because I do have a bad rental history, I'm just curious.

Thanks everyone. I was just curious, because I felt offended that she wouldn't rent to me just because of that. She didn't get any other information about me at all. Which, if it was illegal, I couldn't really do anything about it anyway...because of my bad rental history. But I just think it's funny that she doesn't want to rent to unmarried couples because of problems she's had before. I assumed the couple broke up or something and bailed. But married couples have just the same risk of breaking up. It's what, 50% of marriages end with divorce? My boyfriend and I have been together longer than some people I know have been married. Being married doesn't mean you'll really be together forever anymore.

Unfortunately, marital status is not covered under federal federal fair housing laws. Backward, inbred states like FL, GA, ID, IN, IA, KS, KY, ME, MI, NE, NV, NC, OH, PA, SC, SD, TE, VA, WV apparently believe landlords should have the right to discriminate against unmarried couples. Most of the other states prohibit landlords from discriminating based on marital status.

Federal protected classes include:
• race
• color
• religion
• sex
• national origin
• mental or physical disability
• familial status (including pregnancy).

Some states have other requirements, but no the landlord does not have to rent to you for any other reason.

I don't believe it's illegal for a landlord to not rent to unmarried couples. There are no laws against that sort of discrimination. It IS illegal to discriminate by race, but a lot of landlords do anyway.

Yes, they can do that. It would be the same as them saying that they won't place more than one person on the lease. As an unmarried couple they would be renting to the two of you, not just to one of you, so they would have to depend on both of you for the rent. This becomes an iffy situation for them when it comes to getting the rent. Now, if only one of you was willing to be on the lease and that person met the income requirements necessary to rent at the price asked, then that would be another matter. But if you expect them to place only one of you on the lease, yet look at you as a couple when it comes to determining if your income is sufficient for you to make monthly rent, then they don't have to do that since you aren't legally a couple, and it is a legal contract you are entering into with the lease.

There are different laws in different states and countries. you would need to check with the government department in your area that deals with rental regulations. You could also ask a realtor or real estate agent who specialises in rentals as to the legality of refusing unmarried couples.

Unfortunately if a landlord doesn't want to rent to a certain class of tenant, especially by using direct rental (i.e. not through an agent) it is fairly easy for them to find some legitimate excuse not to rent to you. By the way I am a landlord but I leave all the rental details to my agent.

it sounds legal to do because landlords can chose who they let into their houses. You know they do back up checks and can chose between two tenants. I hope this answers your question.

She has the legal right to do this, and some states even have laws against co-habitation that legally supports the landlord's rights to do this.

North Carolina is one of them.

Understand that being married gives you legal protections that living together does not give you. Let's say that you and your boyfriend rent a home or buy a home and it takes BOTH of your incomes to pay the bills. If one of you dies, the other is left with what they had to start with.

However, if you were married you could file for social security death benefits, and still have the benefit of that income. If you break up, a judge can also order the one that leaves to help with the bills of the one that didn't....courts won't intervene if you are just living together.

I have seen that happen more times than I can count.

You also get significant discounts on car insurance, health insurance, etc.

It's more than a "piece of paper", it's legal protection...and if you are really in a relationship that committed, then why not love each other to PROTECT BOTH of your interests?

I'll tell you why...b/c one of you doesn't really want to.

She actually can not say that, she should tell you she rent it out to somebody already...I don't know you have to see the landlord tenant law of your state..discrimination law..or what..
