Is this legal for a landlord to do?
My mother lives in an apartment building for about 10 years. When she first moved in, the apartment was trashed because the previous tenants left on bad terms with the landlord. My mother cleaned up the whole apartment herself (landlord did nothing) Nothing in the apartment was new except for new paint and minor fixes here and there. About 2 years ago, my mother put in a request to get new kitchen cabinets because the ones that she had were very old and were beginning to break. Also, the bathroom was old as well. The tub must've been there for YEARS. Mother asked the landlord how long has the cabinets been there, turns out since the 70's! The landlord agreed to have the whole kitchen and bathroom replaced with new cabinets and fixtures. He told my mom that she has to pay half. He put in new kitchen cabinets, new tiles for the floor and fresh paint. The bathroom: New tub, new sink/cabinet, new toilet, sheetrock and new tiles. Total cost was about 13 grand. Of course my mother did not have the half to pay at once so he broke it down to where she pays $200 a month with her rent. He made her sign a contract that she is not allowed to move out until all that is paid for. When my mother told me about all this, I was pissed! I don't think it would be my mothers responsibility to pay for some new things in the apartment such as cabinets and bathroom if they were that old and he was supposed to have all the replaced from his pocket! I confronted him and told him that I am looking for a place for my mother and she is going to move out. He gave me an attitude and told me that she signed the contract. I said well even if she didn't get all those new things for the apartment, you would've installed new ones for a new tenant when you put the apartment up in the ad, but you probably would've raised the price up a bit. The landlord raises the rent every September and I'm just furious to how CHEAP this landlord is. Is this legal what he did? I feel so bad for my mom I wish I lived closer to her. I'm in VA and she is in NJ. Any advice would be so greatly appreciated. Thank you.

My mother is not naive. You know what it is?...it's people that are always money hungry and love to screw every innocent victim that's in their path.

Your landlord should not have remodeled like that. He is a freakin' idiot.

That said, he can raise her rent and he can get her to sign a lease that lasts for years (stupid of him, but legal).

He can only bill her part of the remodel if it is due to her damage. If she broke the cabinets, etc. In 10 years she could have done a lot of damage.

So, bottom line, is this might be legal, it depends on the wording of the contract your mother signed.

I don't know if it's legal or not, but it's your Mom's responsibility to not be naive and know what she's signing. If she's that bad, why are you letting her live alone?

The condition of apartment and your mother's efforts to clean it up are irrelevant to issue here.
What LL did is not common, but is certainly LEGAL, splitting cost of improvements with a tenant. He did not have to replace those items, and your mother wanted them replaced and agreed to pay 1/2. She didn't have to do so, it was her choice, her request.
No law says a LL MUST replace cupboards because they're from the 70's. My daughter's apartment has cupboards from the 70s and they're nice oak cupboards. My MIL has cupboards from the 50s which are very solid, although the paint has yellowed. Nothing said LL had to re-do the kitchen and bath in the rental apartment when he did so, or later. Of course the total cost should have been discussed with your mother before she agreed to anything like this. But the LL seems to have held costs down, for that's very reasonable costs for new kitchen and bath. It does seem unreasonable to raise the rent when your mother is paying half the costs of improvements, but that SHOULD have been part of the deal between her and LL, she would pay 1/2 and he wouldn't raise the rent. But that doesn't make it illegal! And your mother has agreed to it, and you say she's not incompetent.

Your attitude to LL got the LL's attitude back. Is your mother incompetent? You're acting like she is and creating problems for her with LL.

Yes, it is legal. As long as everything that was previously there was functioning properly, the landlord had ZERO obligation to replace it, and if she requested it then he has a perfect right to pass those costs along. Also it's quite standard for a landlord to raise rent every year (on renewal of the lease) unless the unit is rent-controlled. The condition of the place on move-in is irrelevant and should have been brought up then. There is nothing to do about it now.

It's legal if she agreed to it. He doesn't have to do the extensive remodeling just because she requested it. Lots of people have kitchen cupboards from the 70's and even much older.

Not all contracts are legally binding. There are certain things that it is illegal to do whether or not you get someone to sign a contract. For instance, here in Ontario, it doesn't matter whether or not you sign a lease that says pets are not allowed; you are still allowed to have pets because it is against the law to ban them.

Most places have some type of tenant protection act which states what a landlord can and can't do, and most places have some type of tenant protection bureau where you can go to for help with such problems as your mother is having.

however i do agree that he shoulnt make her pay, but he could raise rent for redoing all this.
if he pays then rent should be raised, legally, but he shouldnt have done this.

your mom certainly put herself out on a limb. first she agreed to pay half of something that the landlord was responsible for. then she signed a contract backing him up. unless you can prove that your mother is not able to handle her own affairs, that contract is probably legally binding. you can have a contract drawn up for anything, no matter how stupid it is. when both parties sign it, that's that.

edit: haha, you're mother is naive. being tricked by someone is the epidomy of the word naive.

No this is NOT legal. Get a lawyer or perhaps legal aid will help for free. CHeck your states landlord tenant rights. My town has laws for landlords and tenants. Your mom is owed her money back plus the interest. She can move whenever she wants to and no she does not have to pay her landlord to fix his property that she did not cost damage too. She never should have moved in with damages in the first place. I assume she has limited finances to take a place in this condition. But good news there is legal help.

Because she signed a contract it may be legally binding. But if you can somehow prove that your mom is incompetent then you might have a chance of releasing her from her lease without penalty. Get a lawyer and explain to him what has happened. It pisses me off that people take advantage of our elderly. So get that grease-faced landlord for every penny he ripped your mother off for. Let it also be noted that she paid for fixtures and repairs when she first moved in. So, maybe she could get him on that. He runs a roach motel and you should get your mommy out of there ASAP!

It is not legal. The landlord should have replaced everything for free. It is the landlords responsibility to make sure the apts. are safe for his tennants. I would suggest seeking a lawyer in this case. The landlord is wrong and even though your mother signed a paper it might not hold up in court. Especially because of what he did is illegal. Good luck to and hope you get this straightened out.
