If you caused damage to the walls that required repair and painting, the landlord has every right to charge you. The same goes for the late fees. If you didnt pay them at the time of the incident, the landlord can legally take it out of the deposit. You owed the money and he probably has the paperwork to back it up. There is no way $500.00 is just for the paint. There had to be damages involved and labor costs if he had it done by someone other than himself. If you take him to court, you had better have proof you dont owe the money and that there was nothing wrong with the walls, because your landlord will probably have proof against you that you will need to defend. Sorry. |

If the paint in the apartment was damaged by you, or you decided to paint other colors without permission, they can certainly charge you to re-paint the unit. $500 is not out of line for a complete re-paint job. If your rent was late, you can also expect that the late fee charge will be assessed to you. |

Did you paint it a different color during your tenancy? If so, then yes you are liable. You are also liable if you left scuff marks, holes in the wall (even nail holes), smoked or left it generally dirty. |

The late fee need to be charged when it is due not after move out. The paid fee can be charged if you did something to damage it or if it stated in your contract. Try contacting the tenant council in your town. |

You dont have to pay for anything that isnt in your lease. The landlord just cant paint your rental and charge you for it, unless its in your lease. What state are you in, all laws are different. |

No, there is no such law, There is also no such law stating that a landlord has to paint in between each tenant.
An apartment should not have to be repainted after only 1 year of tenancy. Paint has a life expectancy of several years.
If you caused any damage then the cost to repaint is on you.
If you paid late and did not pay the late fee, you are on the hook for that as well.
Your only option is to send a letter disputing the charges and demanding the return of your deposit. If the landlord does not return the disputed amount, then you need to file in Small Claims court. Remember to bring your proof (move in and/or move out photos) to convince the judge that there was not damage and that rent was paid on time. |

There is landlord work for which the tenant is not responsible but look at your lease....this is the sort of thing that may be written in and if it is and you signed the lease, you're out of luck.
Btw....the place to file a complaint is your local Landlord Tenant Board. |

Yes - they can ONLY charge you for the painting if you did something to cause it to be re-painted (IE: painting it some odd color or kids drawing on it or something) other wise it is general wear and tear.
The $65 could have been taken out at the time and they are now telling you about it. When they give you a final accounting they must show all amounts taken out of your deposit even if it is old and that can be confusing sometimes.
But if they cannot prove that it was taken out a year ago- then you can take them to court to get that back, because taking it out after the fact IS illegal. |

i would check the original lease. in this state, the landlord must paint the apartment in between renters anyways, and cannot charge the previous tenant. the landlord can cause for scuffs, holes, etc in the wall, but on a "per incident" basis. they cannot charge to paint the whole wall. i would go to small claims for this one. |

THAT'S BULL **** MY FRIEND IS ALSO HAVING THAT PROBLEM, THEY WON'T CHANGE HER CARPET OR PAINT HER APT. SHE'S BEEN THERE FOR 7 YEARS . BUT FAXING A LETTER TO CORPORATE SHOULD DO SOMETHING, THATS THE STEP SHE JUST TOOK. REMEMBER EVERYTHING IN WRITING TO THEM IS A WHOLE LOT MORE SERIOUS. |
