First off, you need to pay rent.
You have no legal grounds to withhold rent.
You can escrow rent, you can have the tenants right board step in a help you legally break your lease, however you can't stop paying rent.
You should pay your rent. The leaks are fixed and you owe 4 months rent. |

First of all: PAY YOUR RENT!! It is illegal to withhold rent for things needing to be fixed. After 4 months you are very lucky he did not evict you!!
I assume it is fixed now- correct?
If this happens again this is the proper procedure: Send him a certified letter stating the needed repairs and that he has 30 days to fix it or you will have it done and take the cost off of the rent. You must hire a licensed contractor, and be sure to keep the receipt. |

I am sorry you have not studied landlord tenant rights in your state.
I will briefly spell them out.
For A N Y maintenance issue, you have two choices;
if it is an EMERGENCY [roof falling in, no water, etc. that
is called a CONSTRUCTIVE EVICTION AND YOU may leave the
unit immediately and pay no more rent.
IF it is anything else; there are very simple steps to take,
required by law:
give the LL a written notice and wait 30 days. be very specific
about the problem [kitchen sink, toilet, whatever.]
on day 31, call 3 different licensed contractors who repair
these kinds of problems. HIRE one of them.
When he-she is done, and YOU are satisfied with the job,
[drip stopped] PAY the plumber........
keep the invoice.
ON the next rent due day {Jan 2?], send in your normal rent
plus a copy of the invoice MINUS the amount of the paid
invoice. It is that simple. YOU need not apologize or say
anything further.
THERE IS never an excuse for not paying rent.

I was living in my property for 4 months but after 2 months my bathroom ceiling started to leak and i told my landlord asap. After another 2 months nothing had happened and it was very unsafe for me and my 2 year old, not only did we both slip on the floor but it was causing electrical problems as was dripping onto my light switch and i got shocked a couple of times so i stopped paying my rent and when nothing still happened i left. He has caught up with me and is demanding i pay my rent arrears plus about £200 for leaving without giving notice. Anyone know where i stand? |
