Ive overpaid my landlord what should I do(read on)?

Housing Benefit increased my entitlement and as they send cheques direct to the landlord she didnt inform me of the increase and i remained paying my amount which has resulted in her now owing me overpaying her £489.57
how do I get it back from her?!?!

do you know you can really sue her. if she disagrees. because that's breaking the law and stealing your money. honey, just go up to her, be as sweet as you can be, and meddle her down to give your your cash back sugar.

truthfully speaking if the housing benefits find out, they will take it off her as they will see it that they overpaid not you.
you can always ask for a statement from her clearly showing it. then when your rent is due next say ok so i owe you my rent less £489.57 this month.

If you haven't asked yet, then you don't know if she won't give it back.

You are legally entitled to this money, so ring up and ask for it. If she refuses, then tell her that your rent account is in credit and you won't pay any rent until the credit amount is cleared. You are also legally entitled to do that as well!

seek citizen advice bureau help. If you can't get help this way deduct the excess rent paid from future payments of your part of the rent due to be paid to the landlord. They won't be able to evict you because you are not in arrears with your rent. If you are harassed over this consult housing benefits in your local council housing department.

It IS possible it's just a bookkeeping error, so keep it friendly. Believe me, I know owners who have no remedial math skills at all.

I would handle it this way. WRITE to landlord. Let them know you know. Offer to decrease your next rent payment to compensate. That's reasonable.

Demanding money back which you'll just have to turn around and give BACK to them may be counterproductive.

The law has changed and you can get the payment directly to yourself, to stop this happening again. The housin benefit office should have informed you, not her. She just recieves the cheque.

Obviously it hasnt occured to any of the above people that the landlord applied to Housing for an increase in the rent and was approved. AND that it didnt change what the tenant portion was!
If that is the case, the landlord owes you nothing.
Talk to your case worker and find out before you alienate your landlord and find yourself living somewhere else.

assuming you have a rent book which she signs everytime you pay her, and you have letters from housing benefit stating this increse in payment, and you can prove on paper that you've overpaid, then ideally she would keep it and you would be rent free for however long this money covers you for, instead of her giving you the cash back, which would be nice admittedly but that probably isn't going to happen.

if you haven't got a rent book, then its her word against yours and possibly housing benefit might be able to back you up, but you'd have to go to your local CAB.

I work for housing benefits, what you should to is contact your local housing benefit office and ask them to send the cheque to you. It is the tenant who decides who the money is paid to not the landlord. When you have the cheques sent to you, once cashed you can deduct the overpaid amount and give the remainder to the landlord. This way she cannot refuse to repay you because you can deduct the money yourself, and as long as you have receipts for what you have paid there is nothing she can do about it.

i think the best thing you could be is write a letter to hm explaining what has happened and ask him to return the over payment within 14 days MAKE SURE you have a signed copy of this and date it,if possible get to counter sign it as a witness as it is a legal document,if that is no good go to the housing benefit with the proof and explain the problem they may be able to help,if you have proof that is undeniable and he refuses to give you a refund you can take him to tghe small claims court where if you win the case he will have to refund your costs seek to see a solicitor or even welfare rights i hope this helps and good luck stick with it £500 pound is a years wages in some countries and i'm sure it not money you have spare to give away
