I live in University apartments. I share a bedroom wall with a neighbour (not a roommate) who is EXTREMELY LOUD at all hours of the day and night. She is especially loud when with her boyfriend (if you catch my drift)--loud enough to wake up myself and my boyfriend (who is a very heavy sleeper). Last night (a weeknight) we were woken at 4 am. She also plays her bass-heavy music loud enough to shake the items on my shelves (it's happening as I type, actually).
I try to speak politely w/her. She's a ******. It's been the same deal for 8 months now. I thought she'd move out with most of the students at the end of April, but obviously that's not the case. I can't move--I've paid rent though May and June and housing is too tight in my city to find a place (I've been looking with my bf for 3 months now).
QUESTION: community guidelines require 3 separate noise complaints before a tenant is evicted. Should I have my 2 roommates submit complaints along with mine, in order to evict her? Additional Details Joker, if you had actually read my question, you'd realize that is is really loud. Fack you; I'm an adult and I realize the world doesn't revolve around me. |

Maybe if she is spoken to buy the Apartment Manager, she will tone things down. She probably does not want to be evicted. However, you have your rights and if it takes the 3 of you to submit complaints then do it. Sometimes people seem destined to always learn the hard way! |

In the US (which I'm guessing you might not be based on your spelling of neighbor), three separate complaints would mean on different dates, even if by the same person. If the police respond and cite them for a noise violation, it would count as one. Hope this helps with your situation. |

Ask if it bothers anyone else and see if they will file a complaint. Its almost June and you have been putting up with this for 8 months. What is another month or two? You should have addressed this months ago. You can call campus security the next time she is being too noisy. Keep calling them every time she gets noisy in the middle of the night. If she and her BF get interrupted often enough she might get the idea. |

You've done your part, you talked to her, hopefully nicely, first. Now, file formal complaints. You can get your roommates too, but are they complaining?
Or get other neighbors to complain. That'd be more effective.

Oh, I feel for you! I have a flatmate who plays J-rock - which I wouldn't mind were it not for the fact that it's really loud (I can hear it, even though I'm in the first room and he's in the last one, 5 rooms away.).
Yes, submit the complaints. The more you have about her, the better.

I would have your room mates or other people you know that live there submit complaints. You could also call the cops every time she gets loud late at night, eventually they will get tired of it and write her a ticket. |

I mean threaten her , you don't want to get a person kicked out of their home because of something such as noise, imagine if you were homeless. But if she doesn't stop then you know what to do. |

My God, how you must have suffered, to survive through 8 months of living hell. You're either too nice and an absolute angel or you're completely stupid, to allow yourself to be deprived of your civil rights to enjoy peace and quiet by uncaring and obnoxious neighbors, at ANY TIME OF DAY. Every person living in the U.S. is entitled to such rights and to protection by the law, whether citizen or otherwise.
If I were you, I would call the Police on the second time the noise started up, after speaking to them as nicely as possible on the first occasion.
Before any legal action can be taken on anyone, there must be recorded evidence of such events and the only irrefutable evidence is to call the Police to act on such disturbances of the public peace. Don't ever threaten them or let them know that you're going to call the Police and avoid confronting them after the first time, to avoid any adverse consequences for yourself, legal or otherwise. Let the Police do their job.
If they're as unreasonable as you had suggested, they would probably get into an argument with the Police and get themselves arrested, which would provide further basis for legal action against them. Legal action is not confined to eviction but you can also commence legal proceedings against them for the mental duress, anxiety and sleepness nights you or your room-mates have endured.
Don't ever waste your time complaining to your community management staff without irrefutable evidence like a police report because they are not keepers of the peace and no one would be that civic-minded to go out of their way to intervene on your behalf, to avoid being shot at, especially if it's at night. They're not paid to enforce the law. They would have to secure a court order to evict them before they can get the Police to enforce the eviction order, so they can't do anything before any report or complaint is made to the Police.
This is what you must now do. Call the Police immediately if such noise occurs again and if it occurs continuously past a reasonable duration, say 5 or 10 minutes. If no action or response is forthcoming from the Police, then get your room-mates to take turns to call the Police. After the second or third complaint received, the Police would be totally negligient if they fail to respond to your complaints to investigate the matter. You can also continue to call again, even if your room-mates are calling also, as it would lend urgency to the situation.
Even if the Police has responded, your room-mates can also call the Police if the noise starts up again. After the third complaint on the same night, the Police would probably arrest them for disturbing the peace, which is the best tactic to knock some sense into these selfish morons. You can demand for Police assistance, each and every time the public peace is disturbed and your civil rights to enjoy peace and quiet are denied.
After 3 such reports or complaints have been made (you should all receive a case number for each complaint, after giving your statement), you can then demand for the community management to evict them, failing which you can also commence legal proceedings against them for their dereliction of duty, since you've paid your dues as a bona-fide tenant of that community.
The bottomline is never to suffer any infringements on your civil liberties by any irresponsible and unreasonable people because this is AMERICA, where individual rights do stand for something. That's why we have laws and courts to enforce such laws. The Police are trained and paid to keep the peace. You may wish to know that I've successfully taken action on lazy Police who had failed to do their duty to protect the public and to enforce the laws. There are always eager lawyers waiting to pursue such actions on contingency basis, i.e. for free, provided there are evidence or witnesses to support your claim. |
