Landloard made mistake on lease and wants me to resign it to there benifite?
o.k sorry this if this is long but Im just trying to give you the whole story. o.k I live In Minnesota and I went to resign my lease for my appartment and I got a letter saying rent was going up to 520 a month. So I called and old then get a 11 month lease set for me and id be in some time to sign it. so I went in today to sign the lease and notice for the rent rate it read 495 insted of the 520. She went over the lease with me, saying how much it would be after this date and then I signed it and so did she. I then asked for a copy. I got a call from them saying I had to come and resign cause they notice they made a mistake and rent cant go that cheap. I told them well I have a copy call who you need to call im not signing it. and they said I had to and then they called me back saying they found another mistake saying they wrote in the wrong security deposite price. but I had paid that 2 years ago so they said it was voided casue there were 2 mistake on it... so is it still valid???

yeah and thats what funny they keep calling me backing saying how when I got the letter saying rent was going to go up that I knew so that was an agreement... ha ha they think Im stupid but my dad had appartments that he rents out so I know exactly how the system works. just cause Im 20 im not stupid. and the funny thing is she went over it WITH me she read it out loud and still didnt catch it and i noticed right away but why would I say anything! right?

Because this is a signed lease agreement by both parties it is legal and binding. They made a mistake and think you don't know enough and would sign another agreement. They can not evict you for the wrong contract, and they can harrass you for not doing what they ask. If this was to go to court the judge would simply look at this as a property management mistake that the company is legally binded to.

I am not a lawyer but based on everything that I have read a apartment lease is a legal contract. If you both signed the document it is legally in force and they legally have to abide by the agreement. If someone gives you a new copy of an agreement like this to sign you need to study it carefully to make sure that they did not slip in some additional wording that you did not see at first.

Not only is it valid, they have no legal recourse to change or void a signed lease since they also signed it. It is the responsibility of the landlord to make sure the terms are correct on the lease before signing it. That's why a lawyer typically drafts them. Even though they stated the price would be 520, if the lease states it is 495, then that is the legally binding rate.

You go, girl! Don't you dare re-sign that lease. If they take it to court, they will not on ly haev to let you keep the rent but they will have to pay you for court costs and lost wages for having to go to court!

It might be different state to state but I would laugh in their face. Tell them that you signed a lease and you expect them to honor it. It is their responsibility to check the price on the lease form before the two parties sign it, its now a legal document. If they complain too much tell them to take you to court because you would win from what I understand! They definitely would not change it if the error was in their favor!

Absolutely it is still valid, in their office, and in a court of law. They can say mistake all they want, however, it is their bad. It is up to you how far you want to take it.

You are fine. Just don't give them a reason to evict you. You both signed it. I mean they are supposed to proof it before you even go over it. Plus she went over the lease with you. They just have to deal with it. I am willing to bet if it was the other way around they wouldn't be banging down your door to sign for lower rent.

if you wont to have tention between you and your landload then dont sign nothing.when your lease is up then they can correct it,intill then your paper will hold up in court.Its there mistake.you might be looking for a new place to live when its up,becuse they dont have to renew your lease.good look.

You are fighting over $25 a month which you know you owe. Is it really worth having a bad relationship with your landlord for the next year over this small amount of money?
Technically you are correct, a contract is a contract but morally you are wrong. Pay the money or ask to be let out of the lease and move.
